    In north-western Kenya, significant oil reserves have been discovered and the first oil trucks have left Turkana County in June 2018. On the east side of Lake Turkana, the largest wind power project on the African continent was completed in mid-2017. This article applies a local to global perspective to explore the benefits and externalities for the local communities living in close proximity to the oil and wind exploitation sites. A particular focus is placed on governance of energy resources, water and employment opportunities and its impacts on new and existing conflict dynamics.

    The case-study presents the case of the appropriation of pastoral lands by the coming of large-scale extractive industries in Turkana, Kenya. At the same time, it provides this information as a case to local and global civil society, experts, institutions and policy makers.

    Oil exploitation is relatively a new phenomenon in the Kenyan legal system. The current energy laws, fail to identify and establish a relevant institutional and legislative framework for a natural resource benefits sharing regime. Indigenous Local Communities inhabiting oil rich areas disproportionally forgo their enjoyment of their land, livelihoods, endure environmental degradation, increase pollution and relatively poorer health as compared to the rest f the national population. For the above they ought to be compensated and accorded a percentage benefit over and above other Kenyans.

    With the start of a commodity boom cycle in the early 2000s, many resource-rich countries reaped benefits as prices for commodities increased over the ensuing decade. Many of these countries see mining as a central element of modernising their economies, and actively promote investment in the mining and extractives sector. Indeed,between 2000 and 2012, investment spending by global oil, gas, and mining companies increased five-fold, especially in Latin American and sub-Saharan Africa.

    This synthesis of our findings from an investigation of tenure risk in East, West, and Southern Africa, shows that a majority of tenure disputes are caused by the displacement of local peoples, indicating that companies and investors are not doing enough to understand competing claims to the land they acquire or lease. This failure in diligence is particularly noteworthy given that a majority of the disputes analyzed had materially significant impacts: indeed, a higher proportion of projects in Africa are financially impacted by tenure dispute than any other region in the world.
