    This paper analyze the colonial institutions set up by the British to collect land revenue in India, and show that differences in historical property rights institutions lead to sustained differences in economic outcomes. Areas in which proprietary rights in land were historically given to landlords have significantly lower agricultural investments, agricultural productivity and investments in public goods in the post-Independence period than areas in which these rights were given to the cultivators.

    The paper highlights that land degradation in India has been approaching a crisis level in spite of repeated emphasis on wasteland development and existence of apex level organisations for that purpose. One reason has been the policy emphasis on ownership and control rather than appropriate management of the land. It is set in the context of i) the 1988 Forest Policy, and ii) the recent amends to the Forest Conservation Act.

    The authors report on the first empirical study of its kind to examine - from the perspective of transaction costs - factors that constrain access to land for the rural poor and other socially excluded groups in India. They find that: a) Land reform has reduced large landholdings since the 1950s. Medium size farms have gained most. Formidable obstacles still prevent the poor from gaining access to land. b) The complexity of land revenue administration in Orissa is partly the legacy of distinctly different systems, which produced more or less complete and accurate land records.
