    Le présent décret, pris en application des dispositions la loi n° 14/63 du 8 mai 1963 fixant la composition du domaine de l’Etat et les règles qui en déterminent les modes de gestion et d’aliénation, détermine les règles applicables aux cessions et locations des terres domaniales, c'est-à-dire les terres faisant partie du domaine privé de l'Etat et qui ne sont pas affectées à un service public ou une personne privée investie d'une mission de service public.

    This Act amends the Native Lands Act by inserting a new section 65 making provision with respect to unjust enrichment due to improvements made by lawful occupants. Landowners shall pay compensation for such improvements carried out by occupants that occupied or occupy land on the basis of (a) Leases and sub-leases; (b) Transfer of leases and sub-leases (c) Transfer of native lease; (d) Sub-letting; (e) Passing of interest of lessee; (f) Giving up possession and interests of land; (g) Exchange of land; (h) Gifting of land and interest to another.

    Investigates private sector investment in conservation and ecotourism through conservancy land leases in the Mara region of Kenya. In recent and growing tourism development, groups of Maasai landowners are leasing their parcels of land to tourism investors and forming wildlife conservancies. Examines this model and the implications it has for Maasai livelihoods and the environment. Given the large extent and recent change in ownership in these areas, land leases do however keep the lands they cover together and are potentially an optimistic outlook for such open rangeland areas.

    This paper provides an overview of land reform in South Africa from 1994 to 2011, with the focus on the land redistribution. The government policies and associated implementation since 1994 have not generated expected social and economic results for a number of reasons. Even where land has been transferred, it appears to have had minimal impact on the livelihoods of beneficiaries, largely because of inappropriate project design, a lack of necessary support services and shortages of working capital, leading to widespread underutilization of land.

    The body of this report consists of five sections. Section one is an introduction to the JBE program and the context for the lease research on Tanna. Section two provides a profile of some of the relevant historical and economic features of the island and aspects related to the structure of governance and civil society organization. This is followed in section three by a summary of key findings regarding the 64 leases studied on Tanna.
