Land rights are ascendant across the development sector. Movements addressing women’s empowerment, poverty, social justice, food security and climate change are all increasingly turning to land rights to strengthen their cause. This report uses household-level data from 33, mostly developing, countries to analyse perceptions of tenure insecurity among women. We test two hypotheses: (1) that women feel more insecure than men; and (2) that increasing statutory protections for women, for instance by issuing joint named titles or making inheritance law more gender equal, increases de facto tenure security.

The Prindex team presented results of data collected from 15 countries. Amid the realities of major political turbulence, there was growing recognition in 2016 that the land rights of Indigenous Peoples and local communities are key to ensuring peace and prosperity, economic development, sound investment, and climate change mitigation and adaptation. Despite equivocation by governments, a critical mass of influential investors and companies now recognize the market rationale for respecting community land rights.

The new baseline report on ActionAid's Women's Land Rights Project highlights the need for indigenous women in Guatemala, Dalit women in India, and rural women affected by HIV and AIDS in Sierra Leone to gain actual realisation of their land rights. The report suggests that through the implementation of land-related laws and policies that are progressive; the review or reform of retrogressive ones; and the enactment of missing gender-sensitive laws and/or policies, the tide could be turned on the enjoyment of women’s land rights.

The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) - currently ratified by 187 countries - is the only human rights treaty that deals specifically with rural women (Art. 14).
