    Matters of environmental migration are frequently looked at from a humanitarian perspective.1 This policy brief will instead look at it with a lens focusing on land issues. The question of environmental migration is inevitably linked to the question of land for several reasons. First, climate and environmental change trigger and accelerate the loss of land due to sea-level rise, coastal erosion, landslides and other forms of land degradation.

    Conventional notions of the ‘land parcel’ have been extended: previously unrecognized tenures including customary, nomadic, or communal interests are now incorporated into the concept. Technical tools including the Social Tenure Domain Model (STDM) enable these new understandings to be operationalized in land administration systems. The nomadic pastoralists of Kenya’s dry land regions illustrate where these new approaches can be applied.

    After a number of constitutional amendments in 1990 had introduced the need to revise the legal framework for land and natural resources1, the government of Mozambique embarked upon a rather piecemeal process to develop a new policy and institutional framework for natural resource management. The main pillars of this framework consist of various pieces of legislation dealing with specific natural resources, such as the Land Law, the Forestry & Wildlife Law, the Mining Law and their related regulations and annexes.

    The enormity of the world’s dislocated population generated by contemporary conflicts has brought significant attention to a complicated process of returning housing, land and property (HLP) to their rightful occupants once conditions permit. As the complexity of large-scale HLP restitution becomes increasingly apparent, significant obstacles emerge that require examination. This article describes how the ‘evidentiary bind’ is such an obstacle.
