This Ministerial Decree validates the form of land lease contract. The contract envisages the purposeful use of the plot of land, the amount of rent, the boundaries of the plot of land and establishes terms and conditions of lease.

The authorized state institution responsible for the implementation of the present Agreement shall be the State Committee on Land Resources, Geodesy and Cartography of Belarus and the Department of Geodesy, Cartography and Land Cadastre of Ukraine. The Parties have agreed to cooperate in the following areas: (a) topography, geodesy and cartography; (b) exchange of scientific and technical information and cartographic publications; (c) training of specialists; and (d) exchange of information regarding modifications of administrative borders.

The President, with a view of improvement of regulation of land relations and carrying out state control over land management and protection, decrees to set up land survey services within local executive bodies entrusted with the following functions: (a) state control over land management and protection, execution and quality control of land survey and land cadastre work; (b) expropriation and allotment of the plots of land; (c) enforcement of land legislation; (d) submittal to tax inspection of data related to land ownership by natural and legal persons; and (e) exposure of abandoned land.

Article 16 shall acquire a new wording: “Article 16. Amount of rent. Payment for land allotted on lease shall be collected in accordance with lease contract. Basic annual rates of public land shall be set by local self-government with the consideration of cadastre valuation of the plots of land and with the application of factors established by the President of Belarus subject to the purposeful use of land.

The President decrees that plots of land allotted for construction shall be transferred under mortgage exclusively with edifices and constructions located thereon. Transfer of the plots of land in private ownership under mortgage for obtaining land based credit shall be legalized in the form of notarized written contract subject to compulsory registration by the local state authority in the sphere of immovable property.
