These Regulations, made in terms of section 45 of the Communal Land Reform Act, provide with respect to a wide variety of matters concerning communal land and communal land rights. Part I deals with (application for) customary land rights. It specifies the maximum size of land that may be held under customary land right and specifies particulars pertaining to allocation of customary land right.
These Regulations amend the Regulations made under the Sectional Titles Act, 1986 with respect to various matters, with various references to the Sectional Titles Schemes Management Act, 2011. Matters concern mainly documentation and certification. Regulation 30 on management rules as contemplated in section 35 (2) (a) of the Sectional Titles Act, 1986 and regulation 39 on arbitration are repealed.

This Act concerns the establishment, functioning, and jurisdiction of the Land Tribunal. The Tribunal may consist of one or more divisions as the Minister may consider necessary to constitute, each headed by a Land Tribunal President. The Minister shall appoint the Chief Land Tribunal President. A Land Tribunal shall have jurisdiction to - (a) hear and determine a land dispute brought to its attention; (b) hear appeals and review decision of a public body concerning land.

The Committee met to deal with the two proposed amendments that had been made by the National Council of Provinces (NCOP) on the Expropriation Bill [B4B-2015]. The first amendment aimed to increase the number of days in which the municipal manager must inform the expropriating authority, in writing, of charges from 20 days to 30 days, if land which had been expropriated is subject to municipal rates.
The Committee was briefed by the Department of Rural Development and Land Reform (DRDLR) on the performance of Communal Property Associations for March to December 2015. In all, 1 483 Communal Property Associations (CPAs) had been registered since the passing of the Act and 48 were registered in the 2015/16 financial year. The CPAs had been afflicted by a number of problems and the Department had taken steps to address them by the establishment of CPA District Fora to serve as a platform to share experiences.
In this case, which was heard before the Constitutional Court of the Republic of South Africa, The Restitution of Land Rights Amendment Act 15 of 2014 was declared invalid. The Act, among other things, sought to extend the period in which land restitution claims could be lodged. However, the court found that the Parliament did not sufficiently consult with key stakeholders including those who had successfully lodged claims under the previous Act of 1994.
Section 3 formulates a prohibition of receipt or solicitation of consideration in respect of unlawful occupation of land. Section 4 makes provision for the eviction of unlawful occupiers of land. Notwithstanding the provisions of section 4, the owner or person in charge of land may institute urgent proceedings for the eviction of an unlawful occupier of that land pending the outcome of proceedings for a final order, and the court may grant such an order if it is satisfied that conditions set out in section 5 are met. Section 6 provides for eviction at the instance of an organ of state.
This Act makes provision with respect to the recognition of tribes and certain matters regarding the administration of tribes, i.e. the institution of traditional leadership by a person designated by the tribe and recognized by the Minister.The Act, among other things, sets out the procedures for the designation and recognition of traditional leaders, provides for appeal against decisions of the Minister, defines the functions of traditional leaders, defines the jurisdiction of courts in matters of administration of tribes and defines regulation-making powers of the Minister.
This Act makes provision for a wide variety of matters relating to land tenure and reform in Lesotho including the definition of rights in land, allocation of land in rural areas, grant of title in land, vesting of land in authorities, government acquisitions and acquisition and expropriation of land for public purpose, grant of long-term leases and regularization and adjudication of title in land, including resolution of disputes by specialized land courts established under this Act. All land in Lesotho is vested in the Basotho Nation and is held in trust by the King.
