    Purpose of the Law is to ensure urban development, as well as the accomplishment of urban economics and social progress, and to meet the needs of the socialist modernization drive. It consists of six Chapters. In Chapter I (General Provision), it explains that 'urban' means the municipalities directly under the Central Government, the provincial cities and the towns; 'large city' means a city with more than 500,000 population, 'medium size city' means that the population is between 200,000 to 500,000, 'small city' is used for cities where the population is less than 200,000.

    These Measures are formulated in order to exploit, utilize and manage the state-owned land in Lasa City, to strengthen the administration and to accelerate the development of the economy and town construction. Underground resources, burying or hidings and public facilities are not transferable. The city or county government and the land administration department shall be responsible for the task of assignment or transfer of the right to the use, rent and mortgage or terminating the right of use, and also the registration of the construction or the attachment of the land.

    These Measures consist of six Chapters. Chapter 1, General Provisions, provides for the land administration, it restricts the conversion of land. Chapter 2 concerns the ownership of the land. Chapter 3 regulates the management of the right of use. The provisions of the construction of state or collective land are in Chapter 4, including the application procedure of use for construction purpose. Provisions in Chapter 5 are concerning the individual construction use of land. Chapter 6 provides for the legal responsibilities. Chapter 7 contains the Supplementary Provisions.

    Replied by state official letter No. 131 of 1999, it approves the Measures of Examination and Approval of Construction Land, which was submitted by the Ministry of Land Resources. The Measures include six Parts, i.e. 1) Limit of examination and approval, which is regulated in article 44 and 45 of the Land Administration Law. 2) Principle of examination and approval, which are to protect cultivated land and to ensure the use of construction land, etc.

The Land Administration Law shall regulate the right of use the state owned land or the collective land. The right of uses the forestry or grassland should be regulated according to the Forestry Law or the Grassland Law. The province shall implement a registration system in accordance with the Law, the use of state owned land must apply for the certificate of state owned land use. The local government shall compile the comprehensive land use plans.

    The Regulation consists of 30 articles. It defines land supervision in article 2, include the enforcement of land administration law and regulations taken by the land administrative department of county level or above. The empowerment of the land administrative department at different level is regulated in article eight, articles 16 and 17.

    These measures propose to strengthen land administration, the protection of land rights, and to improve utilization of land in Shanxi. Chapter I provides for administration of land. The local government shall restrict conversion of land for agriculture to land for construction. Chapter 2 concerns ownership of land and land use rights. The Province shall implement a land registration system in accordance with the Law. Chapter 3 makes provision for comprehensive land utilization plans to be drawn up by local governments. Chapter 4 contains provisions for the protection of farmland.
