    This Act provides for the recovery of moveable and immoveable assets acquired as a result of an unlawful activity and establishes an Enforcement Authority, an Investigative Agency for this purpose. It also establishes a Recovered Assets Fund. Property which is attributable to property which is recoverable may be mixed with other property where it is used for the restoration or improvement of land.

    This Act establishes the Environment and Land Use Appeal Tribunal, defines its composition and its jurisdiction and provides rules relative to proceedings before the Tribunal. The Tribunal shall hear and determine appeals under section 54 of the Environment Protection Act, under section 7B of the Morcellement Act and under sections 7 and 25 of the Town and Country Planning Act.

    This Act regulates the carrying out of surveys of land by, appointment of, qualifications of, etc. land surveyors including Government surveyors, i.e. land surveyors who are public officers of the Ministry of Housing, Lands and Town and Country Planning. No survey, plan or memorandum of survey, of land shall be valid unless it has been made by a land surveyor appointed by a commission issued by the President. No land surveyor, other than a Government surveyor, shall undertake the survey of any State land, unless he has been authorised in writing by the Chief Surveyor.

    This Act makes provision for the establishment of local authorities, provides for functions and powers of such authorities and for other matters related to local authorities such as the cadastral database and the granting of permits and licenses.Local authorities shall have various functions in the field of control of local matters including control of food, aquaculture and agricultural operations. Section 40 defines the purposes of local authorities. They include the promotion of the environment.

    This Act shall apply to a morcellement, i.e. the division of a plot of land into two or more lots, but not to subdivision for purposes sale to the Government or a compulsory acquisition under the Land Acquisition Act; a mortgage or a fixed charge; or a sale or a donation of not more than one lot and to a division in kind between co-heirs, ascendants and descendants. The Act establishes the Morcellement Board, which shall assess an application for a morcellement permit by a developer. The application shall be accompanied by a plan prepared by a land surveyor.

    The Act makes renewed provision for – (a) generally the protection of wild fauna and flora; (b) giving effect to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and any other biodiversity related Convention to which Mauritius is or may become a party; and (c) the identification, control and management of reserved lands and private reserves, and for related matters.
