Soms bewust en soms onopgemerkt trekt iemand een stuk (gemeente)grond bij zijn tuin, onderhoudt dit jarenlang en behandelt het alsof het van hem is. Landjepik. Na twintig jaar verliest de originele eigenaar zijn eigendom en wordt de ‘dief ’ beloond voor zijn actie. Maar deze wijziging wordt nergens vastgelegd. De notaris kan dit dus niet zien als hij een woning overdraagt. Björn Hoops, promovendus en docent aan de Rijksuniversiteit Groningen, brengt nu in kaart hoe groot dit probleem is.

De mogelijkheden van een gebiedsaanpak zijn in het kader van een Community of Practice verkend. Het doel om een gebiedsconvenant tussen overheden, intensieve veehouderij en terreinbeheerders op te stellen is niet gerealiseerd. Wel is een kader tot stand gekomen die voor toepassing in de toekomst of elders van belang kan zijn. Beerze Reusel kan daarom dienen als praktisch voorbeeld voor een gebiedsaanpak. The Environment and Planning Act is developed as a sequel to the Crisis and Recovery Act. In the context of the Global Financial Crisis, market players hardly realised buildings. In the rare case that a market player was willing to invest, the legal system should not limit investments, but facilitate initiative. Based on this thinking, the Environment and Planning Act is not aiming to facilitate public authorities to secure development based on public interest, but to facilitate takers of initiative that aim to construct even in time of crisis.

This Act places restrictions on the removal of soil on land and in the sea. It is forbidden to remove soil on public or private land without a soil removal permit (art. 3). The permit is not required for soil removal carried out to prevent flooding, for the carrying out of a Town and Country Planning Plan, or the carrying out of a Provincial Environmental Programme (art. 6). The State owns shells, sand, stones, or mud on or under surface waters of the Continental Shelf (art. 4(b)).
