    This project is a component of the project “Piloting of Local Administration of Records - PILAR”, undertaken by the Association for Rural Advancement (AFRA). AFRA is an independent land rights NGO that aims to redress past injustices, to secure tenure for all and to improve the quality of life and livelihoods of the rural poor. Pilar’s main objective is to assist the people of Ekuthuleni obtain legal, affordable and accessible land records in order to improve their tenure security and their access to credit and municipal services.

    THIS report is based on research undertaken by AFRA in 2002/3. The process of compiling the information included an extensive literature review, workshops with the forest dwellers and interviews with various stakeholders. A number of issues were considered and a large volume of literature and workshop reports on these exists in AFRA's offices. These are available on request. The Department of Regional and Land Affairs commissioned a similar study in 1993 when the state was attempting to lure people out of the forest following the 1988 "invasion".

    AFRA is an independent land rights non-governmental organization that works with black rural people in KwaZulu-Natal who were dispossessed and whose land tenure rights remain insecure. As such AFRA engages with the different programs within Land Reform, one of which is the Restitution Program. AFRA works primarily with three claimant groups, the Boschoek claimants, the Dukuduku claimants and the Gongolo claimants, each described briefly below.

The controversy surrounding labour tenancy derives from the fact that the role players within this scenario often hold widely differentiated perceptions about each other’s rights, duties and respective power relationships.

    AFRA’s work at Ekuthuleni started in 1998. It’s now 2004, six years later, and we have to confess that we have failed. It is not possible to secure tenure at Ekuthuleni, for the purposes for which people want that security, within the current legal, technical and institutional frameworks. A small window of opportunity still exists that might allow us to reverse this judgement.
