    Regulation respecting Appeals to Regulations under the Area Development Act.

    This regulation implements the Area Development Act by establishing the Zoning Appeal Board, regulates its membership and operation. Under section 15, the Board has the same powers and privileges as are granted to a Judge for summoning and compelling attendance of witnesses, administering oaths to witnesses, and calling for the production of documents.

    The present Regulations enact section 21 of the Territorial Lands (Yukon) Act. In particular, the Regulation lays down provisions relating to territorial lands. Section 2 establishes that the Regulation applies only in respect of lands that become territorial lands on or after the date the Act comes into force.     This Act concerns the management of land and its resources, including mines, minerals easements, servitudes and all other interests in real property (sect. 1). Under section 2, the Commissioner in Executive Council can designate Land Management Zones for the purpose of protecting the ecological balance of the physical characteristics of any area in Yukon. The Act provides also for sale and lease of lands, for the leasing of mining rights (sect. 10), for the cutting of timber (sect. 16) and for trespass on territorial lands (sect. 18).

    The present Act provides for the subdivision of land or the reconfiguration of any privately titled lot. This includes dividing land into additional parcels, combining two or more lots into one, lot enlargements, making boundary adjustments, condominium surveys and in some cases, long term leases. Whoever proposes such a subdivision must apply to the approving officer for approval of a plan of subdivision in the manner prescribed by the Regulations. Also the creation of a new parcel of land from unsurveyed Yukon Land needs a subdivision approval. The text consists of 27 sections.

    The present Regulation enacts section 149 of the Quartz Mining Act. In particular, the Regulation lays down provisions relating to quartz mining in the territory of Yukon. The Regulation contains provisions on classes of exploration programmes, operating conditions, operating plans, assignment of an operating plan and security.     This Act concerns pounds and the construction of fences for the protection of the ground within its bounds from animals, including horse, cattle, swine and geese. Under section 4, when an animal trespasses any lawful fence, the owner of the land shall return the animal to the nearest pound keeper or district and the owner of the animal is responsible for damages caused to the land or the fence. Under section 6, the owner or occupier of land where an animal is kept, or the person in charge of the animal, is liable for any damage done by the animal as if the animal were of their property.
