    Despite its title, this landmark statute provides the mechanisms for the implementation of a policy of integrated management of land and allied water resources, primarily in a non-urban context, and the institutional arrangements needed to administer and operate such mechanisms (sect. 1). It was enacted largely in response to the state of divided and compartmentalized responsibilities of the central, regional, and local governments in the management of the above-mentioned natural resources.

    There is hereby laid down the legislative framework in matter of town and country planning, in compliance with the principles of subsidiarity, cooperation and sustainability. The regional territory shall be managed through plans approved at the municipal, provincial and regional levels. In order to ensure the coordination of such different plans, article 3 provides for the setting up of the integrated Regional Territorial System. Plans shall be subjected to environmental assessments, so as to contribute to the protection of the environment and regional landscape.

    By way of implementation of Directive 96/61/EC, this Legislative Decree aims at the integrated prevention and control of pollution which arises from the activities specified in Annex I. There are established particular measures intended to prevent and reduce emissions into the air, water and land, comprising general principles in matter of waste management. Furthermore, the Legislative Decree regulates the issue and renewal of the environmental integrated authorization which is required for the installations mentioned in Annex I.

    Within the legal framework laid down in Act No. 183 of 1989, this Regional Act has been enacted to guarantee soil conservation, water restoration and to encourage the rational use of water resources. The Regional Basin Authority, established under the Regional Council (art. 2) shall govern the use and management of regional basins, which are determined by Annex B. The Authority consists of the Institutional Committee (art. 4), the Technical Committee (art. 6) and the Secretary-General (art. 7).

    The present Act provides for the protection of the territory of the Emilia Romagna Region by making rules on land use planning. Cooperation among the Region, the Provinces and the Communes in the field of land use planning and programming is hereby encouraged. Title I lays down general principles applicable to the elaboration of such plans. One of the main objectives is the protection of the environment and natural resources through the reduction or mitigation of impacts that may arise out of plans and projects.

    The present Regional Act aims at the conservation and protection of soil against all negative natural and anthropic agents, at the maintenance of water resources and at the ecosystem preservation, in compliance with the general principles laid down at the national level in Act No. 183 of 18 May 1989. Article 1 contains the list of basins of regional interest to be protected. Such basins are regrouped into the territorial areas defined by article 2. A Regional Basin Authority shall be set up for each territorial area.

    This Act lays down provisions relating to agrarian contracts, giving particular regard to lease and sharecropping. The Act is divided into three different Titles. Title I regulates lease of agricultural lands and sets out detailed rules in matter of duration (the minimum duration is up to fifteen years), tacit renewal, withdrawal and annulment. Article 8 lays down rules for determining the fair rent. Title II of the Act deals with the conversion of lease into other contracts, such as sharecropping. Article 49 (Title III) provides for the transmission of rights on lands to heirs.
