    This Act establishes the land Titles Commission as an independent judicial tribunal for the resolution of disputes of rights in land, including an interest in land, whether arising out of and regulated by custom or otherwise, provides for judicial procedures and the extra-judicial settlement of disputes and some other matters. The Land Titles Commission for Papua New Guinea is established under section 3. The Chief Commissioner is responsible for the administration of the Commission and the co-ordination of the work of the Commissioners.

(IV); Miscellaneous (V).The Land Titles Commission shall complete an adjudication record and shall enquire whether a Native wishes to apply for registration of any native land included in the record by agreement. Further provisions concern the procedure to be followed for said registration.

    Section 2 declares that all land in Papua New Guinea shall be subject to this Act. Section 4 defines matters primarily of national interest for the purposes of this Act. Where consideration is being given to a physical planning matter under this Act, the appropriate authority shall take into account the provisions of the Environmental Planning Act 1978, the Environmental Contaminants Act 1978, and the Conservation Areas Act 1978 and other matters listed in section 5. The Minister may appoint a Chief Physical Planner for the purposes of this Act pursuant to section 6.

    Anecdotal evidence suggests that conflicts over land and extractive resource developments are on the rise across Papua New Guinea. These micro-level conflicts have the potential to scaleup and feed into large-scale armed conflicts—such as those that occurred on Bougainville and in neighbouring Solomon Islands—which require costly external intervention. Against this backdrop, this paper examines PNG’s legally-mandated land mediation system in theory and practice. A number of weaknesses are identified and described; and a case study of an apparently successful “hybrid” approach is discussed.
