    This Chapter concerns the development of a part of Pohnpei declared to be Planned Development Zone. It grants powers to the Public Lands Trust Board of Trustees to enter into lease and use agreements for development stated in line with the integrated development goals of the Pohnpei Government. Development shall be limited to coastal structures for fisheries and tourism.

    This Chapter establish rules for securing public access to areas that are public lands and that are subject to subdivision into smaller parcels, tracts or lots for sale, lease, homestead, exchange or allocated for any other purposes or any public land abutting the sea or tidal areas that is proposed to be sold, leased, homesteaded , exchanged or allocated. The Board of Trustees shall have the power to promulgate Rules and Regulations, subject to the approval of the Governor, to implement the provisions of this Chapter. Such Rules and Regulations will have the force and effect of law.

    This Act concerns land use planning in the State of Pohnpei. Its objectives are to promote responsible and balanced development, to preserve and enhance cultural and traditional values, to conserve and protect the natural environment, and to assure adequate provision for community facilities and requirements. All use of land, both public and private, must be consistent with provisions of this Act.The Act establishes the Pohnpei Land Use Planning and Zoning Commission. The Commission shall prepare a master land use plan, the scope and contents of which are set out in this Act.

One of its objectives is to limit effects of uncontrolled development and land use.For purposes of this Act, the Pohnpei Historic and Cultural Preservation Review Board is established and, within the Department of Land and Natural Resources, a Division of Historic Preservation is created.

    This Chapter makes provision for developmental planning in the State of Pohnpei. The Chapter requires each local government to develop a comprehensive plan for the development of the area where it has jurisdiction. A plan shall consider, among other things, the conservation of natural resources and protection of the environment. The Chapter sets out the procedures for the approval of development plans by the Legislature and provides for hearings and review prior to approval.

    This Act requires the Pohnpei Public Lands Trust Board of Trustees to identify and convey specified land to the Government of Pohnpei. The State Government Land Use Plan Master Plan Map,” is hereby adopted as the zoning map for the purposes of this Act. The Governor shall submit to the Land Use Planning and Zoning Commission the Map and plan for integration into the public services element of the Land Use Zoning Master Plan of the state of Pohnpei.

    The ownership of the foreshore and sea-bed vests in the Crown, subject to the public rights of: (a) navigation and fishing, and (b) of passing over the foreshore, and to any private rights that may exist in or over the foreshore or the sea-bed. The Minister may by notice, after consultation with landowners, designate a foreshore of an island or islet or any part thereof. No person shall remove from a designated foreshore any sand, gravel, reef mud, coral, rock or other like substance without first having obtained from the Chief Lands Officer a licence for that purpose.

    The Act consists of 34 sections divided into 5 Parts: Preliminary (I); Establishment, Membership and Procedure of Land Planning Boards (II); Land Use Plans (III); Development Control and Appeals (IV); General (V).A Central Land Planning Board is established under section 4. The Central Board may with the approval of the Minister by notice designate any area for the purposes of this Ordinance. It shall be the duty of the Authority to promote and assist the investigation, formation and carrying out of projects for the development, improvement and settlement of land. The Authority may establish a reserve fund. The Authority may make rules not inconsistent with the provisions of this Act.
