    Land legislation shall be based on the principles set out in article 3. In accordance with the Constitution of the Kyrgyz Republic, land may be the state, communal, private or other forms of ownership (art. 4). Article 4 also defines state lands and communal ownership. Article 5 concerns rights of foreigners to use land. Transactions with rights to a land plot shall be subject to state registration and shall not require notarization, except for the cases provided by law (art. 9). Article 10 defines the Land Fund of the Kyrgyz Republic.

    This Law regulates the public relations and legal and organizational issues related to the implementation of the land reform in the Republic of Kyrgyzstan. Land reform is carried out so as to provide for the redistribution of the land in order to create the necessary conditions for equal in rights development of various forms of economy on the land, the formation of versatile economy, for the determination of the rates of the fees for land, and the rational use and protection of the lands at the territory of the Republic of Kyrgyzstan.

    This Law consists of VI sections subdivided into XIX chapters that contain 123 Articles. Section I lays down the general provisions. It comprehends Chapters I - II that contain Articles 1-13. Section II regulates ownership and other rights of property on land. It comprehends Chapters III-IX that contain Articles 14-75. Section III gives the classification of the types of land. It comprehends Chapters 10-16 that contain Articles 76-102. Section IV regards protection of land, state control, land survey, land monitoring and land cadastre.

    The Land Code makes provision for the regulation of "land relations" and its purpose is to secure rational use and protection of land, the protection of the environment, and "the equal development of all forms of economic activity in Tajikistan" (Preamble). Other laws regulating land relations may be enacted on the basis of this Code.Land is declared to be in exclusive ownership if the State in article 2.

    This Land Code stipulates that land shall be public property protected by the state and shall be rationally and efficiently managed. It regulates land relations and applies to natural and legal foreign and domestic persons and to foreign states and international organizations.
