    This Act makes provision for the administration of (intestate) estates by persons appointed as administrators under this Act or by (probate of) will and also concerns other related matters of inheritance. Real estate (including lease) of a person dying intestate shall devolve in the manner provided by section 4, and the residuary estate of that person shall be distributed in accordance with section 54.

    This Act makes provision for the administration of estates in Belize of deceased foreign persons. It assigns powers to representatives of specified countries of origin of the deceased person to administer the estate if there is no person present in Belize at the time of death who is rightfully entitled to administer the estate of such deceased person. Nothing contained in this Act shall affect the Crown’s right under the Administration of Estates Act. The representative shall apply for letters of administration to be issued by court.

    The Minister may declare adjudication areas for the purposes of this Act (sect. 3). After a declaration made under section 3, the Minister shall appoint a land Adjudication Tribunal for the adjudication (sect. 4). The Tribunal consists of an Adjudicator and two other members who shall be land surveyors or, lawyers or land economists. The Adjudicator, assisted by a demarcator and a records officer appointed under section 4, plays an importation role in procedures for the preparation of an adjudication.     Section 3 defines kinds of land holding tenancies, i.e., tenancy for years, a tenancy from year to year, a tenancy for less than a year, a tenancy at will and a tenancy on sufferance. The tenancies defined in section 3 comprise the relationships between landlord and tenant in Belize and, subject to this Act, have the same qualities and incidents as they would have under the common law of England.

    This Act provides generally for registration of rights in land and land tenure in Belize. “Land” includes land covered with water, all things growing on land and buildings and other things permanently affixed to land. Except as otherwise provided in this Act, but subject to section 38 of National Lands Act, no law, practice or procedure relating to land shall apply to land registered under this Act so far as it is inconsistent with this Act.
