    For the purposes of subsection 29(3) of the Australian Capital Territory (Planning and Land Management) Act 1988, the period of 999 years is prescribed in respect of estates granted in Territory Land all or part of which was, immediately before that grant, the subject of a perpetual lease or a lease for a term of 999 years. The Authority may charge the fee specified in column 3 of an item in the Schedule for the service set out in column 2 of the item.

    Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms. In the Environment Protection and Biodiversity Conservation Act 1999 subsection 9(3) is repealed. In the Regional Forest Agreements Act 2002 subsection 6(3) is repealed. In the Resource Assessment Commission Act 1989 section 31 on evidence on heritage values of a place is completely renewed and some minor amendments are made.

    The Australian Heritage Council is established by section 4. The functions of the Council are: (a) to make assessments under Divisions 1A and 3A of Part 15 of the Environment Protection and Biodiversity Conservation Act 1999; (b) to advise the Minister on conserving and protecting places included, or being considered for inclusion, in the National Heritage List or Commonwealth Heritage List and various other matters; (e) to promote the identification, assessment, conservation and monitoring of heritage; (f) to keep the Register of the National Estate under section 21; etc.

    The Council must keep a register of places in the Australian jurisdiction and their heritage values (‘Register of the National Estate’) in accordance with the Act and these Regulations and Regulations. If the Australian Heritage Council proposes to include a place in, or remove a place from, the Register of the National Estate, it must: (a) inform the appropriate authority of the State or Territory government and the local government (if any) of all or part of the place about the proposal; and (b) give the authority a reasonable opportunity to comment on the proposal.

    Section 3 provides for the validation of invalid planning instruments. Any proceedings in any court (including the proceedings in relation to: (a) any of the planning instruments in so far as they apply to the relevant land (whether or not the instruments apply to any other land); (b) any development application, grant of consent or grant of concurrence referred to in section 3 (2); or (d) any associated matters in any court shall be terminated (sect. 4).
