After more than two decades of agrarian change in Tajikistan, farming structures seem to crystallise. The first signs towards farm individualisation were observed only around 2000, which were the result of significant pressure from outside, when the post-conflict state was highly susceptible to pressure from multilateral institutions. Over time, striking differences in agrarian structures have emerged nation-wide; from highly fragmented, autonomous farms, to elite-controlled large-scale cotton farming.

This third report comprises two parts: Part 1 contains an analysis of policy options and recommendations for the preparation of a law on land rights and title restitution. The recommendations are based on LLP’s research findings, its comparative case studies, an analysis of existing legislation and on relevant input of stakeholders that participated in LLP’s roundtable on land rights in June 2004. According to estimates by the International Land Coalition based at the International Fund for Agricultural Development (IFAD), 57 million hectares of land have been leased to foreign investors since 2007. Current research has focused on human rights issues related to inward investment in land but has been ignorant of water resource issues and the challenges of managing scarce water. This handbook will be the first to address inward investment in land and its impact on water resources in Africa.
