The Act consists of 37 sections divided into 5 Parts: Preliminary (I); Devolution of Real Estate (II); Executors and Administrators (III); Administration of Assets (IV); General (V).Real estate to which a deceased person was entitled for an interest not ceasing on his death, shall, on his death and notwithstanding any testamentary disposition thereof, devolve on the personal representative of the deceased.

This Act grants powers within Montserrat to the Consul, Vice-Consul, or Consular Agent of a State to administer the estate of a deceased person of such State. Such Consul, Vice-Consul, or Consular Agent shall immediately apply for, and shall be entitled to obtain from the Court, Letters of Administration of the property of the deceased person, limited in such manner and for such time as to the Court shall seem fit.

Persons specified in section 3 may apply to the Registrar to be appointed as administrator. Section 4 provides for nomination by a Judge in case of probate of will of a deceased person. Duties and powers of the Registrar are set out in sections 5 and 6.

This Act establishes the Administrative Appeal Tribunal. The Tribunal shall hear and determine appeals from decisions of certain tribunals and authorities in accordance with this Act. Appeals may be had from, among other things, decisions made by the Commissioner of Valuations under section 21 of the Land Valuation Act, decisions of the Commissioner of Estate Duty under section 36 of the Estate Duty Act and decisions of the Collector of Taxes under section 14 of the Land Tax Act.

This Act: makes provision for the appointment of the Administrator-General for Jamaica by the Governor-General; defines functions and powers of the Administrator-General and provides with respect to the functioning of the Administrator-General and relevant judicial and administrative procedures, especially in respect of the administration of estates. The Administrator-General shall apply for letters of administration relative to the estates of all persons who shall die intestate and without heirs.
