    This Law requires a licence to be obtained for a new undertaking or a new development. “Development” has the same meaning as in the Island Planning (Jersey) Law 1964. An application for a licence shall be in the form required from time to time by the Minister and shall contain or be accompanied by such particulars as the Minister may require. The Minister may attach conditions to a licence. Appeal against decisions of the Minister may be had with the Royal Court.

    This Law grants power to local authorities to authorize the occupation of a “chose publique”, i.e. any area of land over which the public has, under the customary law of Jersey, the right to pass without let or hindrance, whether on foot or with animals or vehicles, including any highway, but excluding any park or sea beach. This right of occupation restricts the public right of access to the area of land in question.

    This Act sets regulations on public and private fences to delimit property boundaries. The Act applies to the use of fence for delimitation of land and sets regulation on the type of fences permitted, make thereof (metal, electric, bush), agreed size of fences, their maintenance etc. The establishment of fences must be paid by both parties and should be in style of the building/construction belonging to it. Changes may occurr subject to pre-agreement on size and costs.

    The Act stipulates rules for the creation, enforcement and extinction of real burdens, and special rules for community burdens and manager burdens. A “real burden” is an encumbrance on land constituted in favour of the owner of other land in that person's capacity as owner of that other land. Other burdens regulated by this Act include: Conservation burdens, community burdens, management burdens, rural housing burdens, maritime burdens, economic development burdens, and health care burdens.
