    An Enactment to amend the Land Acquisition Ordinance (Cap. 69).

    According to section 2, section 21 of the Land Acquisition Ordinance is hereby amended by substituting a colon for the semi-colon appearing at the end of the proviso to paragraph (a) and inserting immediately thereafter the following new further proviso: Cap. 68: "And provided further that the fact that the land is held under Part IV of the Land Ordinance or any other written law in the State relating to native land tenure shall by disregarded in determining the value of the land;".

    According to articles 65, 66 and 67 of the Land Code (1991), National Land Cadastre should provide information, to all citizens and every kind of organization, for the safeguard of efficient land use and land protection, for the harmonization of laws on land use and landownership, for the organization of proper use of land, as well as for the qualitative description and evaluation of the land, and for other issues related to land use.     The agricultural lands owned by the State, burdened with the right of "disposal" of persons who personally or through others cultivated it, according to the "agricultural density" decided for them, shall be considered as owned by the state without compensation and shall be registered in the name of the Ministry of Finance as a pure property and the Ministry of Agriculture shall dispose of such lands in accordance with Laws and Resolutions in force (comma A of par. 1).

    The plantation of lands specified in the Master Plan of the City of Baghdad shall be carried out in accordance with the Plan within the limitation of the tree line. Planting of certain seasonal crops is excluded from this provision (art. 1a). The requirement laid down in article 1a concerns water share. Cultivation of lands without a water share shall commence one year after the allocation of a water share has taken place (art. 1b). Non-compliance with the requirement may bring about the modification of the lease contract (art. 2).
