    A major gap in understanding the situation in India with respect to land and its control is the takeover of common lands, which rarely figures in discourses on land. The Society for Promotion of Wastelands Development (SPWD, New Delhi) and RRI commissioned case studies on the takeover of common lands in India in an attempt to fill this gap. This paper is a compilation of those studies. Based on these case studies, an international conference was held in December 2012 to reflect the current situation and discuss possible policy actions.

    The mining sector’s current situation, with socially and environmentally disruptive practices making news regularly, is a powerful reminder that change is required. The proposed Mines and Minerals (Development and Regulation) Bill offers a unique chance to lay a sound basis for responsible extraction of the country’s natural resources. A series of amendments in India’s legal framework over the past two decades have opened the mining sector to private investments. It was hoped that this would support economic development in some of India’s poorest states.

    This brief presents a review of 161 Intended Nationally Determined Contributions (INDCs) submitted on behalf of 188 countries3 for COP 21 to determine the extent to which Parties made clear commitments to strengthen or expand the tenure and natural resource management rights of IP/LCs as part of their climate change mitigation plans or associated adaptation actions.4 Of the 161 INDCs submitted, 131 are from countries with tropical and subtropical forests.

    The Joint Forest Management circular that took the National Forest Policy (1988) as its basis for people’s involvement in the development and protection of forests, issued more than 18 years ago, has failed in its attempt to utilise forest wealth to improve local livelihoods. The structure of the JFM is skewed towards the forest department and needs to be balanced with equal opportunities and rights to the participating communities.

    The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act (RFCLARR) was enacted in 2013 replacing the land acquisition policies prevalent in the country since 1894. A year later, the Government of India on December 31, 2014 issued an ordinance making significant changes to the Act including removal of consent clause for acquiring land for areas of industrial corridors, public private partnership (PPP) projects, rural infrastructure, affordable housing and defence.
