It specifies what constitutes conservation land and the related tax exemption provisions (Part IV). It provides for the settlement of disputes related to the managed forests property class (Part VI) and of disputes relating to conservation land (Part VII). Part VIII is dedicated to the assessment of pipelines.

This Act concerns the expropriation of land, which includes “any estate, term, easement, right or interest in, to, over or affecting land” (sec.1). Under section 2, the Minister has the power to expropriate any land he or she deems necessary for public purposes. The Act provides for compensation for disturbance, injurious affection of land or expropriation to be assessed and paid. Section 13 provides for the establishment of a Board of negotiation to solve disputes related to expropriation.

Regulation respecting Appeals to Regulations under the Area Development Act.

This regulation implements the Area Development Act by establishing the Zoning Appeal Board, regulates its membership and operation. Under section 15, the Board has the same powers and privileges as are granted to a Judge for summoning and compelling attendance of witnesses, administering oaths to witnesses, and calling for the production of documents.

Land fees shall be charged for lands falling under the main classification of the unified land territory or special usage land specified in the Article 10 of the present Law and possessed or used by citizens, business entities, or organizations according to land possession and/or usage contracts. This Order of the President made under section 19 of the Tribal Land Act, 1968, amends the Schedule to the principal Order by establishing the Mogoditshane Subordinate Land Board. As a consequence the Third Column of the Schedule of the principal Order is amended by deleting some territories listed under other Subordinate Lands Boards.

An Act to make provision in the case of dispute for the sale of undivided interests in immovable property.

This Act provides for remedies in the case of disputes involving sale of an immovable common property that is undivided in shares. Any owner may request the Court to direct the sale of the property and the distribution of proceeds thereof. The Court shall have also discretion to direct a sale where sale is not requested by an owner of a moiety or upwards in accordance with section 4 (sect. 5). The Court may allow parties interested in the property to bid at the sale. Parties are allowed a partition suit. Section 8 regulates the relationship between this Act and other law. (10 sections)
