The regulatory framework for land administration, land information management, planning and building consists of laws, regulations, standards, norms, and administrative procedures relating to land development that seek to determine what developers, land-owners, communities and residents are entitled to do with and on that land. Unless specified, they should apply equally to all these groups, organisations or individuals seeking to acquire, develop or transfer urban and rural land. The regulatory framework determines also the rules, responsibilities and procedures regarding the collect and the processing of land information, and land administration.

Kenya is the most recent African state to acknowledge customary tenure as producing lawful property rights, not merely rights of occupation and use on government or public lands. This paper researches this new legal environment. This promises land security for 6 to 10 million Kenyans, most of who are members of pastoral or other poorer rural communities. Analysis is prefaced with substantial background on legal trends continentally, but the focus is on Kenya’s Community Land Act, 2016, as the framework through which customary holdings are to be identified and registered.

Pastoralists have a unique relationship of mutual dependency with their livestock and their environment; the uniqueness of this relationship distinguishes them from other livestock keepers. They depend highly on the environment where they develop their livelihood, that they make productive through highly adapted animals, but at the same time the quality of this environment depends on how well they take care of it, which in turns depends on complex social regulations and on large-scale mobility. The way they keep their animals forms part of their daily life and of a complex culture.

ASF serves the most vulnerable people waiting for justice

ASF intervenes in countries where human rights are not respected, where political violence and armed conflict reign, and where legal rules are flouted.  Justice in those countries, too often arbitrary, does not guarantee the security of the population.  Conflicts are not satisfactorily resolved before the local courts.  People whose rights have been abused tend to resort to vigilante justice, which evolves into the law of the strongest or richest, and contributes to a climate of violence.
