La Quatrième Conférence Régionale sur la Sécurisation des Droits Fonciers Communautaires en Afrique, qui s’est tenue à Arusha, en Tanzanie, du 12 au 14 septembre 2023, a réuni des délégués de l’emsemble du continent pour aborder la question cruciale des droits fonciers communautaires. L’événement était organisé par Rights and Resources Initiative (RRI), le Ministère des Terres, du Logement et du Développement des Établissements Humains, la Land Alliance de la Tanzanie (TALA) et le Forest Conservation Group de la Tanzanie (TFCG).
Lors de la conférence les délégués ont souligné l’importance de mettre en œuvre des processus d’attribution de titres de propriété communautaires comme moyen de protéger les terres rurales contre les empiétements et les conflits. Ils ont reconnu que les rôles des Institutions Nationales des Terres varient d’un pays à l’autre. Par exemple, le ministère de l’Éthiopie se concentre principalement sur la résolution de l’insécurité foncière en milieu rural par le biais de l’enregistrement foncier pour atténuer les conflits, tandis que l’Autorité Foncière du Liberia joue un rôle central dans l’administration foncière et l’application de la loi pour éviter les chevauchements de fonctions entre les ministères.
La conférence a également été l’opportunité d’échanger ouvertement sur les obstacles courants à la mise en œuvre efficace de l’Agenda de l’UA sur la tere, notamment les limitations des capacités institutionnelles, les défis liés à l’éducation des communautés sur les politiques foncières et le financement insuffisant pour l’infrastructure et la documentation. Les principales recommandations comprenaient l’amélioration des systèmes d’information foncière, l’éducation des communautés rurales sur l’enregistrement foncier, la surveillance des tendances des données et la réalisation de recherches sur les droits fonciers.
Le Dr Dominico Kilemo, conseiller de NELGA pour l’Afrique de l’Est, a souligné deux aspects cruciaux conformes à la mission de NELGA. Il a plaidé en faveur d’une collaboration plus étroite entre les Institutions Nationales en charge de la gestion du foncier et des universités pour éclairer les décisions et les politiques concernant les droits fonciers communautaires. De plus, il a proposé l’organisation de forums nationaux pour rassembler les parties prenantes et pour faciliter des dialogues politiques solides sur cette question.
La conférence a vu la participation de partenaires de développement influents tels que la Nations Unies Commission économique pour l’Afrique (UNECA), la Banque Africaine de Développement (BAD), l’Organisation des Nations Unies pour l’Alimentation et l’Agriculture (FAO), la GIZ et le Fonds pour la Sécurisation des Droits Fonciers. Ces organisations ont directement interagi avec les représentants des institutions foncières, abordant les préoccupations et apportant leur soutien à la mise en œuvre des droits fonciers communautaires.
En résumé, la Quatrième Conférence Régionale a servi de plateforme dynamique pour des discussions éclairantes, le partage des connaissances et des recommandations. Ces efforts contribuent collectivement à la recherche de droits fonciers communautaires sécurisés en Afrique, soulignant l’importance de la collaboration et de la prise de décision basée sur les données dans la gouvernance foncière régionale.

Bien que l’impôt foncier constitue une source majeure de revenus pour les administrations infranationales, il reste l’un des plus sous-performant dans les pays à faible revenu. Ce n’est qu’un exemple de la façon dont, dans de nombreux pays, les efforts des gouvernements infranationaux en matière de collecte de revenus sont souvent inefficaces, inéquitables et en manque de redevabilité, en particulier en ce qui concerne l’impôt foncier. Les résultats qui en découlent menacent la capacité des pays à répondre aux besoins et priorités urgents en matière de dépenses.
