This Act provides rules relative to the holding of title and other rights in land by persons other than a permanent resident or other than persons acquiring land or an interest in land under a devise or by inheritance (“Non-Bahamian”) and makes provision for control by the State on the holding of title in land in the Bahamas by foreigners. Acquisition of land, other than by non-Bahamians, shall be registered with the Secretary of the Investments Board, which is established under this Act.

The principal Act is amended by the insertion of a subsection (4(4)) on the power of the Investment Board to validate, on such terms and conditions as it may think fit, any purported conveyance, mortgage, transfer of mortgage or other acquisition of an interest in land made contrary to subsection (1) of section 4 by issuing a permit to the non-Bahamian. Subsection (1) of section 4 requires a non-Bahamian who wishes to acquire land or an interest in land either by way of freehold or leasehold, which acquisition is not within section 3(1), to obtain a permit from the Board.

The present Law shall define organizational, economic and legal terms and conditions of foreign concessions in Turkmenistan. A concession shall provide for the right given by the state to a foreign legal entity or a natural person – a concessionaire – to use plots of land, natural resources, enterprises and other assets on the basis of an agreement for a specified period of time and in return for a payment. Concession activity in Turkmenistan is carried out in accordance with the following principles: rational use of natural resources, ensuring ecological, sanitary and hygienic safety.

Cette ordonnance porte régime foncier. Elle comprend 22 articles répartis en 4 titres. Le titre I - Dispositions générales - définit l'Etat comme gardien de toutes les terres et comme garant des droits dérivant de la propriété. Les interventions de l'Etat pour assurer un usage rationnel des terres ou pour tenir compte des impératifs de la défence ou des options économiques seront fixés par décret. Le titre II porte régime de la propriété privée.

This Act provides for the imposition of an annual levy on land owned by an absentee (as defined by this Act. The levy shall be charged on the unimproved value of the land, i.e. the capital sum that might be expected to be offered for the fee simple with vacant possession of the land at a bona fide sale on such reasonable terms and conditions as a bona fide seller would require, it being assumed that no improvements had been made on or to the parcel of land. The Act allows for objections to be lodged against assessment of value.

El presente Decreto Ley, que consta de 2 artículos, modifica el artículo 6º del Decreto Ley Nº 8/1984, de 3 de mayo, que transfiere al estado la propiedad de las fincas rústicas abandonadas por los extranjeros, disponiendo que se anula totalmente y queda sin efecto todo acto jurídico celebrado con posterioridad al 5 de marzo de 1969 por el propietario registral de un bien abandonado a favor de terceros.

El presente Decreto Ley, que consta de 8 artículos -vencido el plazo establecido en el Decreto Nº 22/1988, de 20 de febrero, por el que se concede un plazo de 60 días a los extranjeros propietarios de fincas rústicas y urbanas para recuperar sus propiedades y ponerlas en explotación-, tiene por objeto regular de modo definitivo la situación legal de los bienes raíces, rústicos y urbanos, sitos en territorios de Guinea Ecuatorial y que se conozcan como bienes abandonados (art. 1º).
