Coast Protection Ordinance (Cap. 85).

This Ordinance prohibits certain activities on land bordering on the sea or any tidal water and having its seaward boundary at the low water mark. It shall be prohibited to remove sand and other material without a licence granted by the Governor under this Ordinance and to deposit offensive substances or litter on the coast.

Soil Conservation (Scotland District) Act.

This Act makes provision with respect to soil conservation in the Scotland District and for this purpose establishes the Scotland District Soil Conservation Board.The Board shall advise the Minister on the utilization of lands in the conservation area, i.e. the area as set out in the First Schedule to this Act. It shall also examine proposals concerning the conservation and improvement of land in the conservation area submitted to it under this Act by the Chief Agricultural Officer.

Foreshore Licences Act 1945.

This Act prohibits the carrying out of foreshore works other than with a foreshore license to be applied for under section 3 to the Minister responsible for development and planning. "Foreshore work" means: (a) the constructing or laying down of any building, structure or works on the foreshore or on the bed of the sea; or (b) the installing or deploying of a floating dock; or (c) land reclamation on the foreshore or the bed of the sea not exceeding one acre in extent.

Decree-Law No. 65/98 establishing the conditions for coastal land expropriation in the district of Praia.

This Decree-Law consists of 5 articles establishing the conditions under which a very urgent procedure of land expropriation is allowed for turistic purposes within the District of Praia. It also includes coastal zone infrastructures' expropriation for touristic development. It concerns as well the financial compensations to be paid to landowners according to Act No. 54/98 of 29 June 1998.

Cette loi fixe les dispostions principales relatives au domaine public maritime, composé par le domaine public maritime naturel et par celui artificiel. Ce domaine doit être délimité par rapport aux propriétés riveraines; cette délimitation est confiée à une commission spéciale, dont la composition et fonctionnement seront fixés par décret, et sera effectuée selon les critères et les modalité prévus au chapite II de cette loi. Les terrains limitrophes au domaine public maritime sont gravés des servitudes prévues au chapitre III.

Act No. 7.661 establishing National Planning for Coastal Zone Management.

This Act establishes National Planning for Coastal Zone Management. It consists of 13 articles laying down competencies and duties of the aforementioned national administration. It also lists sanctions to be paid by offenders in case of environmental areas pollution, according to article 14 of Act No. 6.938.

The purpose of this Act is to protect national coasts to avoid flooding and degradation of land from the sea, fiords and other territorial sea areas. Coastal protection methods take into consideration the following: economic consideration, coastal protection measures of technical and environmental quality, coastal landscape conservation and restoration, recreational use of the coast, ensure the maintenance of existing access to the coast, and other issues of significant importance for coastal protection.

The purpose of the present Act is to: a) provide for the protection of beaches and associated dune systems as significant and sensitive environmental and recreational resources; b) provide for the regulation and enforcement of the full range of land-use activities on beaches, including aggregate removal, so as to leave them unimpaired for the benefit and enjoyment of future generations; c) control recreational and other uses of beaches that may cause undesirable impacts on beach and associated dune systems.

Amendments made to the principal Act concern its application sphere, compulsory land acquisition, incentives for aquaculture projects, conversion of agricultural land into fish ponds and prawn farms, protection of mangrove areas, and change of crops. Lands actually, directly and exclusively used for parks, wildlife, forest reserves, reforestation, fish sanctuaries and breeding grounds, watersheds and mangroves, as well as private lands actually directly and exclusively used for prawn farms and fishponds, shall be exempt from the application of this Act.

American Samoa Coastal Management Act of 1990.

This Act provides for the establishment of coastal management program and the designation of coastal zone and special management areas and related matters. The American Samoa Coastal Management Program (ASCMP) is established as an office within the Executive branch. The Office of Development Planning shall be the designated territorial agency, as required by federal law, for the administration and implementation of Program. The general purpose of ASCMP is to provide effective resource management by protecting, maintaining, restoring, and enhancing the resources of the coastal zone.
