Highland Council (Eigg) Harbour Empowerment Order 1999 (S.S.I. No. 201).

This Order confers upon the Council the power to carry out and maintain works in the island of Eigg, Highland, and on the foreshore and bed of the sea adjacent thereto and for that purpose, compulsorily or by agreement to acquire land and rights in land. The Order also confers further powers on the Council to maintain and operate their undertaking at the harbour as a statutory harbour undertaking and defines the limits of jurisdiction of the Council.

Based on the assessment of the present environmental degradation caused by the inadequacy of the purification systems, and of the data collected through an official census on the water pollution of the country, the special plan aims at the achievement of the following objectives: (a) identification and implementation of urgent interventions necessary for the protection and sanitation of waters and catchment basins; (b) completion of works already financed; (c) putting into operation of completed works. The Decree establishes criteria and modalities for the elaboration of the plan.

These Regulations amend the principal Regulations which provide for payment to eligible persons who, in respect of an area of eligible land, undertake not to use such land for a period of at least twenty years and to manage the land with the objective of establishing an area of salt-marsh in accordance with prescribed management requirements. They amend the rate of payment of aid to beneficiaries in respect of land which was permanent grassland at the start of the management period.

These Regulations implement provisions of the Survey Act with respect to the Land Surveyors Board, the Standing Committee on Geographical Names, the examination and issue of licences, land survey operations, government land surveys and resolution of disputes. These Regulations prohibit the taking or removal of sand from the foreshore other than the foreshore within the limits of any harbor if no written permit signed by the Minister is obtained. Likewise the taking of sand from any Crown land or any other holding without a permit is prohibited. Offences are prescribed.

This Order concerns licences granted under section 9 of the Beach Control Act. The Order contains rules relative to an application for licences, payment of fees and prescribes provisions included in a licence. Every licence shall contain a provision giving the competent authorities to take specified corrective action in case of encroachment not permitted by the licence.
