This Act concern the definition of coordinated systems for purposes of land survey in the State of Chuuk and specified lagoons. The Chapter also gives some indications for a valid survey but does not require a purchaser or mortgager to entirely rely on the defined system. The Chapter also prescribes penalties for the offence of interfering with survey marks.
Chapter 1 of Title 30 of the Code of Federated States of Micronesia- Federated States Development Bank.
This Act provides for the establishment of the Federated States of Micronesia Development Bank as a body corporate, defines its functions and powers and internal organization.The Bank shall be instrumental in: mobilizing additional financial resources for development; providing of loans for projects; technical assistance; and administration of trust funds and special funds. Foreign ownership of the Bank is prohibited because of the legal capacity of the Bank to acquire, own title to, dispose of, and otherwise deal in land and waters in the Federated States of Micronesia.
Chapter 15 of Title 24 of the Chuuk State Code - Deeds of Trust.
This Chapter concerns the establishment of deeds of trust in respect Chuuk land and in favour of the United States Government through the Farmers Home Administration or other federal agencies. The deed of trust shall secure the financing of real estate projects and transactions by the United States of America. The Chapter also provides for judicial and non-judicial foreclosure related to the deed of trust.
Chapter 9 of Title 24 of the Chuuk State Code - Public Projects Act.
This Act concerns compensation for fruit-bearing trees destroyed or damaged due to work on public projects. No claim for compensation shall be paid unless the destroyed tree is certified in the manner as prescribed by this Act. Claims shall be presented to the Division of Land Management in the Department of Resources and Development in the manner as prescribed by this Act. Every public project funded by the State Legislature which involves the destruction of trees to which this Act applies shall reserve 3 percent of the total appropriation for tree compensation.
Earthmoving Regulations.
These Regulations regulate earthmoving operations, i.e. any construction or other activity which disturbs or alters the surface of the land, coral reef or bottom of lagoons (reg. 1.3). All earthmoving operations in Micronesia shall be conducted in accordance with these Regulations and in such a way as to prevent accelerated erosion or accelerated sedimentation (reg. 2.1). Erosion and sedimentation control measures shall be set forth in a plan to be prepared by qualified persons in accordance with requirements laid down in reg.
