Moçambique é um país repleto de instrumentos – políticas, estratégias, pacotes legislativos – para o desenvolvimento. O combate à pobreza, a desigualdade de género, o desenvolvimento rural, entre outros, são temas tratados nesse leque de instrumentos orientadores. Este trabalho tem como objectivo discutir a integração da mulher camponesa no processo de desenvolvimento rural, tendo em consideração as constantes preocupações com a equidade de género.

Em vários países em desenvolvimento, a agricultura é a principal actividade e é tida como a base para o crescimento das suas economias. Em Moçambique, apesar do emergente crescimento da indústria extractiva nos últimos anos e da redução considerável da percentagem de pessoas que tem a agricultura como actividade principal (de 60% em 2005 para 54% em 2012, segundo o Inquérito Agrário Integrado de 2012), a actividade agrícola continua a ser o principal sector económico, empregando a maior a parte da população, sobretudo no meio rural.

This is the first issue of the Journal of Law and Rural Development, published by IFAD. IFAD’s mandate to address rural poverty and promote rural development is unique among international organizations. For many years IFAD limited its activities to financing projects and programmes implemented by its Member States, but over the last decade it has begun to transform itself into a knowledge centre and a key participant in the international policy dialogue around rural development issues. The launch of this journal is another step forward in this transformation.

ABSTRACTED FROM EXECUTIVE SUMMARY: This is one of four thematic studies on customary tenure in Cambodia, Lao PDR, Myanmar and Vietnam. These studies seek to present an analysis of customary tenure arrangements in each country and identify key challenges and opportunities for strengthening the legal recognition and protection of customary tenure. The present study on Myanmar focuses on customary tenure among upland ethnic nationalities, where colonial and state land administration systems have been poorly integrated, allowing customary systems to be sustained over time.

WEBSITE INTRODUCTION: This document presents the experiences of two investors, Stora Enso Laos and Outspan Bolovens Limited, who have invested in agribusiness plantations (eucalyptus and coffee respectively) in the south of Lao PDR. It discusses the lessons learned on four key topics related to responsible investment: (1) land acquisition, (2) compensation and benefit sharing, (3) community engagement, and (4) grievance mechanisms.

Land tenure in Vietnam is becoming increasingly contested in the context of rapid economic development and growing inequality. Agricultural land in and around cities is targeted by developers for conversion to commercial uses. In rural areas, farmers' access to productive land is restricted by the prevalence of state-owned farms and forest enterprises. As a result, the number of complaints filed over land issues has increased dramatically in the last decade, and the revision of the Land Law in 2013 led to an unprecedented level of public participation in land policy formation.

WEBSITE INTRODUCTION: In the Mekong region, conflicts between local communities and large scale land concessions are widespread. They are often difficult to solve. In Cambodia, an innovative approach to conflict resolution was tested in a case involving a private company, Hoang Anh Gia Lai (HAGL), and several indigenous communities who lost some of their customary lands and forests when the company obtained a concession to grow rubber in the Province of Ratanakiri.

Conflicts persist between forest dwelling communities and advocates of forest conservation. In Thailand, a community forestry bill and national park expansion initiatives leave little space for communities. The article analyzes the case of the predominantly ethnic Black Lahu village of Huai Lu Luang in Chiang Rai province that has resisted the threats posed by a community forestry bill and a proposed national park. The villagers reside on a national forest reserve and have no de jure rights to the land.

ABSTRACTED FROM EXECUTIVE SUMMARY: Land rights systems in Southeast Asia are in constant flux; they respond to various socioeconomic and political pressures and to changes in statutory and customary law. Over the last decade, Southeast Asia has become one of the hotspots of the global land grab phenomenon, accounting for about 30 percent of transnational land grabs globally. Land grabs by domestic urban elites, the military or government actors are also common in many Southeast Asian countries.

WEBSITE INTRODUCTION: This book examines large-scale land acquisitions, or ‘land grabbing’, with a focus on South-East Asia. Thematic papers and detailed case studies put this phenomenon into specific historical and institutional contexts, analysing transformations in livelihoods, human rights impacts, and potential remedies.

Agrarian resistance often occurs as a result of expropriation and dispossession of poor farmers’ land and other properties. This paper examines how cost-benefit rational choice determined the government of Cambodia’s response to poor farmers’ resistance to large-scale land acquisition for an agro-industrial investment. Theoretically, whatever mechanism a government chooses to respond to resistance, the aim is to retain more benefits, especially political legitimacy.
