This Regulation 739 of 2017 amends and supplements Regulation 725 of 2015 regarding the organization and functioning of the Territory Development Agency. The changes include: appointment and termination of the General Director of the Agency by the Prime Minister; replacement of the integrated territory registry with the electronic permits system; and exercise of several ministerial functions by the Prime Minister.

These Regulations amend the Neighbourhood Planning (General) Regulations 2012 so as to, among other things: insert a new definition to explain what a modification proposal is, in relation to a neighbourhood plan, and with respect to the procedure for making a neighbourhood development plan in Part 5.

These Regulations amend the Town and Country Planning (Local Planning) (England) Regulations 2012- to insert the definition of an upper-tier county council; prescribe the time period for review of certain local development documents; consequential to the amendments to Part 2 and Schedule A1 of the 2004 Act made by section 10 of, and Schedule 2 to the 2017 Act. Section 9 of the 2017 Act inserts new sections 28A to 28C of the 2004 Act, providing the Secretary of State with a power to direct two or more local planning authorities to prepare a joint development plan document.

This Regulation sets forth the procedures and principles of consolidation and distribution of agricultural land. This Regulation aims at rural development and planning of rural areas. This Regulation sets forth provisions on planning of rural areas, land consolidation, registration procedures, land classification, land subdivision, land distribution and expropriation.

This Regulation sets forth procedures and principles of (i) improvement and classification of agricultural lands, (ii) determination of land and soil resources specified in the Law No. 5403 on Soil Preservation and Land Utilization, (iii) land-use planning in compliance with the sustainable development principle, (iv) determination of erosion-sensitive areas, (v) implementation of soil conservation and land management plans and projects, and (vi) establishment and duties of the Soil Preservation Board.

Land is an essential building block of civilization yet its contribution to our quality of life is perceived and valued in starkly different and often incompatible ways. Conflicts about land use are intensifying in many countries. The world has reached a point where we must reconcile these differences and rethink the way in which we use and manage the land.

These Regulations implement provisions of the Land Act, 2012, with respect to a variety of matters including administration of public land and private land, conversion of freehold or leasehold tenure, compulsory acquisition, settlement programmes, easements and analogous rights, and evictions from unlawfully occupied public land.The National Land Commission shall keep and maintain a data base of all public land and an inventory of land based natural resources.

Article 22 shall be amended to add the following wording: “The decisions of the municipal council or local level special territorial planning documents (except for special territorial planning land use planning documents) specify the solutions of the municipal master plan and, by the decision of the municipal council, special territorial planning documents are recognized as an integral part of the municipal master plan.
