Part 1 of the Planning and Compulsory Purchase Act 2004 establishes a new system of regional development planning in England. These Regulations make provision for the operation of the regional planning system. The Regulations set out the criteria for the recognition of a Regional Planning Body ("RPB") and regulate its preparation of an annual monitoring report and regional participation statement. They prescribe the form and content of a draft revision of a Regional Spatial Strategy ("RSS") and regulate the procedure to be followed in connection with the preparation of the draft revision.

Section 12(2) of the Planning and Compulsory Purchase Act 2004 enables the Secretary of State by order to direct that if an area of a National Park falls within more than one region of those, except London, specified in Schedule 1 of the Regional Development Agencies Act 1998, it is treated as falling wholly within one of them. This Order directs that the North York Moors National Park and the Yorkshire Dales National Park are treated as falling within the Yorkshire and Humber Region and that the Peak District National Park is treated as falling within the East Midlands Region.

The purpose of these Regulations is to facilitate compliance with the European Court of Justice ruling of 21 September 1999 (Case C-392/96) that the EIA thresholds adopted by Ireland in relation to initial afforestation and peat extraction exceeded the discretion available to Ireland under Directive 85/337/EEC on Environmental Impact Assessment in that they did not take account of the nature, location or cumulative effect of projects below these thresholds. The threshold for mandatory EIA in relation to these activities is reduced.

These Rules provide for the institution and responsibilities of the related Authority in relation to: the registration of wells and the licence to drill wells; the construction of rain water harvesting structures; the registration of rigs; the prohibition of water contamination, for both surface and groundwater; land use and water quality; the forestation of urban areas, etc. The Authority may take over wells in order to ensure supply of drinking water to local population. Violations of the provisions of these Rules shall be punishable with fines specified in section 26.

These Regulations set out a number of procedural requirements in relation to the preparation of regional planning guidelines by regional authorities. These procedural requirements supplement those already set out in the Planning and Development Act 2000. The Regulations also specify the National Spatial Strategy as being of relevance to the determination of strategic planning policies. This means that regional authorities must take account of the National Spatial Strategy when preparing and making regional planning guidelines.

These Regulations carry into effect in Ireland Directive 2001/42/EC on the assessment of the effects of certain plans and programmes on the environment insofar as the Directive relates to plans and programmes in all of the sectors listed in article 3(2) of the Directive except land-use planning. The Regulations concern the consideration of the likely significant effects on the environment of such plans and programmes.

These Regulations carry into effect in Ireland Directive 2001/42/EC of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment insofar as the Directive relates to land-use planning. The Regulations concern the consideration of the likely significant effects on the environment of specified public development plans. The Regulations prescribe procedures and contents of environmental reporting, monitoring and assessment in relation to each type of plan. A consideration of transboundary environmental effects in specified cases is also made.

The present Regulation determines the modalities of ensuring protection of geodetic points. Geodetic point consists of special centre, external identification mark and external design represented by a ditch or bank that is the external boundaries of a geodetic point. Protection zone of a geodetic point is a plot of land on which it is situated and the strip of land of the width of 1 metre adjoining the external boundary of the geodetic point.

Le présent décret met en exécution la loi du 26 octobre 1978 sur les constructions. L’article 1er établit que l'Etat encourage les mesures d'aménagement prises par les communes et les syndicats de communes: a) en octroyant des subventions pour l'aménagement local et régional; b) en facilitant le financement de la viabilité de terrains à bâtir par l'octroi ou la négociation de prêts et par des cautionnements; c) en soutenant par des prestations particulières les mesures prises au titre de la protection du paysage et les autres mesures d'aménagement d'importance régionale ou cantonale.
