Regulation amending the Regulation on land cadastre.

This Regulation amends certain provisions part of the Regulation on land cadastre (Official Gazette 84/2007).Changes are related to the specific types of use of the official register and cadastre records, types of use of buildings and facilities, and other technical provisions regarding the occupancy permit, the final report of the supervising engineer, the solution of the derived condition, built certificate, the certificate authority responsible for the construction of the building.

This Act makes provision for the registration of deeds relating to immovable property and the appointment of the Registrar of Deeds. It also provides rules for the alienation of land by the State, the manner of transfer of land in general and concerns rights in immovable property and related to leases. If the State alienates State land not previously registered in the name of any other person, then the State may transfer the ownership in the land to the transferee by means of a deed of grant issued in terms of proper authority.

This Regulation of the Forestry Development Authority (FDA) establishes the responsibilities of Person harvesting or making Commercial Use of Forest Resources under a Forest Resources License ("the Operator") with respect to the rights of private land owners and provides for a right of compensation to land owners harmed as a result of any activity or process carried out pursuant to a Forest Resources License. The Operator shall take all measures necessary to prevent harm to the property of private land owners resulting from operations, without limitation.

This Regional Law establishes that plots of agricultural land within the boundaries of inhabited areas and destined for agricultural production, free of constructions and edifices, allotted on lease on condition of permanent (open-ended) land tenure as a result of renewal of lease contract or renewal of the right of hereditary possession of such land with the right of lease can be purchased in ownership by lease holder at the cost of 15 percent of cadastre value of such plots of land.

The present Regulations are made under the Lands Act. In particular, the Regulations provide for the control of development activities in the St. John’s Urban Region. Section 4 lays down provisions relating to the control of development and establishes that a development shall not be carried out within the development area described in the Schedule except in accordance with the present Regulations. The text consists of 25 sections.
