Aboriginal and Torres Strait Islander Act 2005.

This Act concerns self-government and self-sufficiency of Aboriginal persons and Torres Strait Islanders, the economic and cultural development of and the use of lands by descendants of original habitants of Australia. The Act establishes the Torres Strait Regional Authority (TSRA), the Indigenous Land Corporation and a corporation to be known as Indigenous Business Australia. TSRA shall, among other things, formulate and implement programs for Torres Strait Islanders, and Aboriginal persons, living in the Torres Strait area.

This Act provides for the recovery of moveable and immoveable assets acquired as a result of an unlawful activity and establishes an Enforcement Authority, an Investigative Agency for this purpose. It also establishes a Recovered Assets Fund. Property which is attributable to property which is recoverable may be mixed with other property where it is used for the restoration or improvement of land.

Alienated Lands Act (Cap. 145).

This Act makes provision for the registration of alienators having the right to negotiate negotiation of alienation of land of custom owners and the registration of mortgages on alienated land. Furthermore the Act provides for various matters relative to negotiation of land and consequences of alienation. Notwithstanding the provisions of the Land Reform Act, Cap. 123, the Minister shall cause a register of alienators to be kept (sect. 2) and if the Minister is satisfied that an applicant under section 3 is an alienator he shall register him as such in the Register.

This Act stipulates that every person who shall unlawfully persist in wandering or remaining upon any plantation, land or premises having been warned not to come thereon or to depart therefrom and every person who enters by night any dwelling-house, or any verandah or passage attached thereto, or any yard, garden or other land adjacent to or within the curtilage of such dwelling-house without lawful excuse, shall be guilty of an offence and on conviction thereof shall be liable to a fine.

This Act provides with respect to perpetual succession to land. Trustees or a trustee may be appointed by any community of persons bound together by custom, religion, kinship or nationality or by any body or association of persons established for any specified purpose, or for any purpose which, in the opinion of the Minister, is for the benefit or welfare of the inhabitants of Zambia or any part thereof. Such trustees or trustee may apply to the Minister for a certificate of registration of the trustees or trustee of such community, body or association of persons as a corporate body.

The President decrees that allotment on lease or in ownership shall be performed exclusively out of stock of public land (excluded agricultural land) with broad public participation and with the participation of Public council under the President of Chechen Republic and Councils of elders of inhabited localities. Plots of land shall be put on auction sale for purchase of the right of lease and the right of ownership.

This Regional Law regulates relations concerning turnover of agricultural land within plenary powers pertaining to the jurisdictional competence of the regional administration. It establishes terms and conditions for allotment of plots of agricultural land pertaining to state and municipal property, and also the modalities of expropriation thereof in regional and municipal ownership. Agricultural land shall be used exclusively for agricultural production.

This Law regulates relations concerning ownership, land tenure, and disposal of agricultural land. It establishes terms and conditions for allotment of plots of agricultural land pertaining to state and municipal property, and also the modalities of expropriation thereof in regional and municipal ownership. Agricultural land shall be used exclusively for agricultural production. Privatization of agricultural land, pertaining to regional of municipal property shall be authorized beginning from 1 January 2005.

This Law regulates relations concerning ownership, land tenure, and disposal of agricultural land, establishing plenary powers of regional administration and local government in the sphere of turnover of agricultural land. It establishes terms and conditions for allotment of plots of agricultural land pertaining to state and municipal property. Agricultural land shall be used exclusively for agricultural production. Privatization of agricultural land destined for distant (outrun) pastures and reindeer grazing shall be prohibited.
