The Preamble of this Act declares the purposes of the enactment of new provisions relating to the ownership of land to be: (a) to alleviate the consequences of some injuries suffered by the owners of agrarian and forest property in the period of 1948 to 1989; (b) to provide conditions for improvement in the care of farm and forest land through renewing the original relations of ownership of land; and (c) to create conditions in accordance with the need of economic development of rural regions and in accordance with requirements for landscape and environment conservation and management.The t

This Law establishes forms of property ownership, providing for the recognition and protection of property rights. Owners (physical persons, legal entities or the State) shall have the right of possession, use and transfer. Objects of property rights covered by this Law include: land, soil, water, air space, vegetation and wildlife, buildings, installations, equipment, subjects of material and spiritual culture, intellectual property, information, money, securities and other moveable and real property. The law provides for joint ventures as well.

This Act establishes periods of limitation and other limitations for bringing actions of the various classes mentioned in the Act. Section 42 extends the applicability of the Act also to arbitration. Actions include various actions in respect of land: actions to recover land by the Crown or any person and rent; action to recover money secured by a mortgage or charge or to recover proceeds of the sale of land; and actions in respect of trust property or the personal estate of deceased persons and actions for an account.

Under this statute people are permitted to lease land and to bequeath its use to their heirs in perpetuity. Ownership of land is delegated to local soviets, which fix the prices for land rentals. While heritable land can be worked as property, it cannot be sold, granted or mortgaged. The drafting of more detailed rules on land tenure is delegated to the Union republics, within the framework laid down by the statute. In practice, farmers will henceforth be free to choose between being collective farm members or individual farmers.

De conformidad con lo dispuesto en la presente Ley, todos los títulos de reforma agraria, provisionales o definitivos, entregados a los asignatarios del proceso de reforma agraria serán considerados como el instrumento que les otorga la propiedad de la tierra y el derecho de poder ejercer la plena disposición del dominio y posesión; en consecuencia, dichos asignatarios podrán vender, traspasar o heredar (art. 2º). This Act makes provision for a wide variety of matters relative to tenure of and transactions regarding land for which a certificate of title was issued.The certificate of title of lands to which this Act applies shall be issued by the registrar of Titles in the form as set out in the Second Schedule to this Act.
