This Decree establishes the modalities of conclusion of contract for lease of public land and land local government. It contains the modalities of calculation of lease rent, lays down essential provisions inserted in lease contract and model form of lease contract. Interested natural and legal person shall submit to local government or state body application containing cadastre identification number of the plot of land requested in lease, specifying intended period of lease.

This Decree establishes the modalities of calculation and payment of immovable tax, specifying that public land and land of local government that is not allotted in lease or let on hire shall not be subject to application of immovable property tax. Local government shall register payers of immovable property tax.

These Regulations amend the Leases Restrictions Regulations 1977 by inserting new provisions concerning criteria to be applied by the Tribunal in a decision on any application for approval of a lease, sublease, assignment of lease or assignment of sublease to a non-resident. The criteria of assignment of lease concern citizenship of the Cook Islands, procedures regarding information to natives and consent of assembled owners resident on the island.

This Order establishes the Urban land Leases Selection Committee, which shall, within the Municipality of Port Vila: (a) consider, on behalf of the Minister responsible for lands, all applications for the granting of new leases, transfer of leases and surrender of leases for the creation of new leases, transfer and transfer of shares between lessor and lessee companies; (b) advise the Minister on any matter in relation to the such transactions; and (c) do or perform such other functions or responsibilities as the Minister may from time to time direct or delegate.

There shall be maintained in Port Vila a Land Records Office in which shall be kept a register to be known as the Land Leases Register. This Ministerial Decree regulates registration of agricultural land of the members of cooperative classified as loan capital and other land owned by the members of cooperative. Agricultural land classified as loan stock shall include agricultural land except for land stock constituting authorized capital stock. Cooperative shall be liable to its members for the use of loan capital for agricultural purposes. Cadastre map of the inhabited area shall be integral part of the register of cooperative land.

This Ministerial Decree establishes the modalities of calculation of minimum and, in case of necessity, maximum land charges for lease of public and private agricultural land. It shall not be applicable to reserve land allotted to retirees and social workers and poor households to which special fixed tariffs shall be applicable. The amount of annual land charges shall be calculated at the moment of the conclusion of contract and also in case of modification of land charges envisaged by the contract.

This Order sets out certain obligations of landlords and tenants in their relationship regarding private tenancies. It also empowers district councils to issue notices of unfitness and notices of disrepair in respect of dwelling-houses let under private tenancies and to issue certificates of fitness to be issued in respect of certain dwelling-houses. Rent officers or a rent assessment committee may determine a rent limit in respect of tenancies which are subject to control.
