This Regional Law establishes that plots of agricultural land within the boundaries of inhabited areas and destined for agricultural production, free of constructions and edifices, allotted on lease on condition of permanent (open-ended) land tenure as a result of renewal of lease contract or renewal of the right of hereditary possession of such land with the right of lease can be purchased in ownership by lease holder at the cost of 15 percent of cadastre value of such plots of land.

This Act, consisting of 3 Parts and 2 Schedules, establishes that all land which immediately prior to the commencement of this Act was vested in the Maori Trustee subject to the provisions of Part 14 or Part 15 of the Maori Land Act 1931 shall, at the commencement of this Act, become vested land subject to the provisions of this Act. On the commencement of this Act, all vested land shall cease to be subject to any trusts theretofore applying to the land, and the land shall be administered and dealt with in accordance with the provisions of this Act.

This Regional Law establishes the modalities of calculation of land lease fees, terms and conditions of payment thereof for public land and for land with undefined land ownership. Rates of land lease fees shall be established in percentage depending upon purposeful and authorized types of land tenure. Land lease fees shall be established on annual basis. This Regional Law contains calculation formula for land lease fees.

The Act, consisting of 44 articles, is enacted to ensure permanent management of the agriculture by means of developing agricultural technology, introducing agricultural technicians, gathering agricultural technology industries, and accelerating the transformation of the agricultural industry.The establishment and administration of an Agricultural Technology Park shall be governed by the provisions of the Act.

Thees Enforcement Rules are enacted pursuant to Article 43 of the Act of Establishment and Administration of Agricultural Technology Parks.The duties of the Agricultural Technology Park Administration may be entrusted to other government agencies, administrative legal entities, or private organizations to handle upon requirements.

This Act amends the Land Registration Authority Act 2003 by adding a new section (438A), which stipulates that no lease shall be subject to sublease unless specifically agreed to by the landowners in the original master lease, or consented to by the landowners in writing.

The Schedule to the Land Leases Act is further amended by the repeal of subparagraph (b) of paragraph 3 and the substitution therefore of the following paragraph:"(b) The Government, any Local Government Council, any Municipal Council and the National Housing Corporation shall be exempted from payment of any fees under this Act."

A new section is inserted which prescribes that it shall be implied in every registered lease created prior to a specified date or created on or after the relevant date an agreement between the lessee and the lessor to the effect that lessee shall not dispose of the leased land or part thereof or interest comprised therewith without the previous written consent of the lessor, and the lessor shall not withhold such consent by the unreasonably.

This Regulation provides for the implementation of various amendments made in 1998 to the Land Law (the land use right, its certification, granting, the subjects entitled to them).

Article 7.1 shall be amended to add the following wording: “Lease contract for agricultural land, destined for haymaking and grazing, pertaining to public or municipal property shall be concluded for the maximum period of three years”.

Any agricultural land owned by any person in excess of the ceiling established by the Land Reform Commission shall (a) be deemed to vest in the Commission; and (b) be deemed to be held by the former owner under a statutory lease from the Commission in compliance with the terms and conditions set out by the Law.
