Agricultural Leases (Reletting) Act.

This Act establishes rules governing the reletting of agricultural land. Where a lessor desires to make any change in the conditions of a lease on the expiration of its term, unless an agreement is reached with the tenant, he shall apply to the Rural Leases Control Board (which is established under article 5) and indicate the proposed changes. The Board may reject, approve or modify the new conditions proposed by the lessor. Article 4 regards the non-renewal of lease.

La presente Ley establece el marco normativo para promover el cumplimiento de la función social de la tierra fiscal, mediante su arrendamiento y enajenación en forma progresiva y orgánica a favor de los auténticos trabajadores del campo. El objetivo principal de la Ley es la protección del campesinado y la reactivación de la tierra fiscal. This Regional Law establishes priorities of the regional land policy as follows: (a) conservation of most valuable land; (b) conservation of agricultural land and protected areas; (c) realization of the right of regional residents to land allotment; (d) land tenure by methods ensuring conservation of ecosystem; and (e) payment of land charges for land use. Public and municipal land can be allotted to citizens in ownership, on lease, permanent (open-ended) tenancy or fixed-term tenancy free of charge.

The present Land Code regulates land relations and is aimed at the creation of conditions for rational land tenure and soil conservation, reproduction of soil fertility, conservation and improvement of environment for the purpose of the equal development of all forms of economic activity. Land is the property of the state. Citizens have the right to allocation of a plot of land terms and conditions of which shall be determined by the present Act (art. 2).

Law No. 8318 on Leasing Agricultural and Forest Land, Pastures and Meadows which are covered in the State Property Law 1995.

This Law provides for the leasing of public agricultural and forest land. It consists of 18 articles establishing the procedures for leasing of such lands to citizens and contains rules relative to the lease and the conditions attached to lease including obligations of the lessee. 'Land' here means the land that is property of the State, classified in the fond of agriculture and forest land, pastures and meadows (art. 2).

This Law makes provision for the payment of the use of land in the form of land tax and lease fees. The rates of land tax are established in article 2. Land tax shall be established on cadastrial documentation and be imposed on land users who are manufacturing agricultural products. Payment shall also be made for land not used for agriculture. Categories of users specified in article 9 are exempted fromthe payment of land tax. They include "dehkan", private farms during three years or one year depending upon the type of land.

Regional Law No. 60-ZS “On protected areas”.

This Regional Law regulates relations in the sphere of organization, protection and management of protected areas. It classifies protected areas as follows: (a) state nature reserves, including biosphere reserves; (b) national parks; (c) nature monuments; (d) dendrological parks and botanical gardens; and (e) healthcare areas and spas. Protected areas of regional significance shall be property of the regional administration and shall be managed by public administration.

Regional Law No. 56-OZ “On transfer of state plenary powers related to transfer on land on lease”.

This Regional Law regulates transfer of state plenary powers related to transfer of public land on lease. It establishes that local self-government shall be competent institution related to allotment of public land on lease within the boundaries of municipal units.

This Act makes provision with respect to the protection and conservation of ancient monuments and related matters such as the acquisition of land by the Government for purposes of this Act. All ancient monuments and antiquities, whether upon any land or in any river, stream or watercourse, or under territorial waters of the country, shall vest in the Government and no person shall possess or have in custody any ancient monument or antiquity except under a licence granted by the Minister in the prescribed form.

Regional Law No. 625 “On turnover of agricultural land”.

This Regional Law regulates legal regime, the modalities of allotment, turnover of agricultural land, including land shares in common property, and is aimed at the prevention of reduction of agricultural land area as a result of transfer thereof to other categories of land, degradation or decrease of soil fertility, and establishes terms and conditions for transfer of agricultural land to the producers of agricultural commodities ensuring the most efficient use of agricultural land.
