New valuation fees push up the cost of land and homes

The cost of buying land and homes is set to rise significantly as the market factors in new valuation charges that have more than doubled for most asset classes.

Lands minister James Orengo introduced the new charges through an amendment to the forms and fees section of the Valuers Act, paving the way for their application in the property market beginning this month.

Valuation fees for certain classes of land or homes have increased by up to 400 per cent, piling upward pressure on sale prices.

Forest Conservation Project Empowers Community to Restore Mau Forest’s Glory

USAID is assisting the Kenya Government (GoK) to restore the forest and watersheds in the Mau Forest Complex (MFC) through a $7 million, two-year project called ProMara (for the Mara). On March 25th 2011, USAID/Kenya’s Deputy Mission Director James Hope officially launched ProMara at the project’s new Mau Outreach Center (MOC), on the outskirts of the forest. The Mau Forest Complex has a history of illegal and irregular land allocations. In 2009, GoK acted on Mau Task Force recommendations to revoke questionable titles, ordering the eviction of "illegal" settlers from the MFC.

Indigenous Territories and REDD in Latin America: Opportunity or Threat?

An important proportion of Latin America’s forests are located in indigenous territories, and indigenous peoples are the beneficiaries of about 85% of the area for which local rights to land and forest have been recognized in Latin America since the 1980s. Nevertheless, many of these areas, whether or not rights have been recognized, are subject to threats from colonists, illegal loggers, mining and oil interests and others, whose practices endanger not only the forests but also indigenous people’s territory as a whole.

En el presente artículo se analiza la regulación del derecho de propiedad privada en la Constitución española de 1978 y, a través de ella, algunas cuestiones generales del sistema constitucional español. Tras examinar la trascendencia político-constitucional del derecho de propiedad, se estudia el artículo 33 de esta Constitución: las bases históricas e ideológicas del concepto de propiedad consagrado en él y el significado del principio de la función social.

El derecho romano de la propiedad en la doctrina civil colombiana

El artículo muestra cómo la doctrina civil colombiana ha acogido recurrentemente la idea de que los romanos dividieron el derecho de propiedad en tres propiedades o atributos: usus, fructus, y abusus. Luego, el texto pasa a los textos primarios romanos, poniendo en evidencia la ausencia de esa tridivisión entre los jurisconsultos. El análisis continúa con los textos secundarios de derecho romano, resaltando la manera en que las obras colombianas con frecuencia le atribuyen al derecho romano la tridivisión, mientras los textos extranjeros normalmente no lo hacen.
