PacLII stands for the Pacific Islands Legal Information Institute. It is an initiative of the University of the South Pacific School of Law with assistance from AustLII. PacLII is a signatory to the Montreal Declaration on Public Access to Law and participates in the Free Access to Law movement, (FALM) a grouping of a number of world wide organizations committed to publishing and providing access to the law for free. PacLII is based at the Emalus Campus of the USP in Port Vila, Vanuatu.

 

USP School of Law is based in Port Vila and has students located across 12 countries of the Pacific who do not have easy access to the legal materials from across the region which they need to undertake their studies. PacLII was started by the School of Law as a means to overcoming the tyrannies of distance. It has grown to become a service to governments, legal professionals, NGOs, students, academics and members of the public and has been widely recognized as an example of excellence in promoting access to legal information.

 

PacLII collects and publishes legal materials from 20 Pacific Islands Countries on its website www.paclii.org which is hosted by AustLII. These countries are American Samoa, Cook Islands, Commonwealth of Northern Mariana Islands, Federated States of Micronesia, Fiji, Guam, Kiribati, Marshall Islands, Nauru, Niue, New Caledonia, Palau, Papua New Guinea, Pitcairn Islands, Samoa, Solomon Islands, Tokelau, Tonga, Tuvalu and Vanuatu.

 

The materials consist mainly of primary materials such as court decisions and legislation but also include decisions of various tribunals, panels, Ombudsmens reports or secondary information such as court rules or bench books. PacLII is now seeking to expand its collections to include law related materials such as subject specific papers and reports. PacLII is also developing a series of subject specific libraries utilising predetermined search technology. An Intellectual Property and a Maritime Law Library have been created and more are planned. A number of Pacific Islands Treaties are also available but direct access to the database has been suspended due to a current lack of capacity.

Physical Planning Act 1989.

Section 2 declares that all land in Papua New Guinea shall be subject to this Act. Section 4 defines matters primarily of national interest for the purposes of this Act. Where consideration is being given to a physical planning matter under this Act, the appropriate authority shall take into account the provisions of the Environmental Planning Act 1978, the Environmental Contaminants Act 1978, and the Conservation Areas Act 1978 and other matters listed in section 5. The Minister may appoint a Chief Physical Planner for the purposes of this Act pursuant to section 6.

Native Land Trust (Leases and Licences)(Amendment) Regulations 2010 (L.N. No. 130 of 2010).

These Regulations amend the Native Land Trust (Leases and Licences) Regulations in regulation 11 by repealing paragraph (1) and substituting that paragraph of these Regulations. They also repeal paragraph 3 of regulation 11. Paragraph (1) concerns the distribution of moneys received by the Native Lands Board by way of rents and premiums in respect of native land.

Preservation of Sites and Artefacts (Amendment) Act 2008 (No. 21 of 2008).

This Act amends the Preservation of Sites and Artefacts Act [CAP 39] in relation with the classification of objects and sites, the protection of classified sites or objects, appointment of Heritage Inspectors and the definition of their powers. The Minister may, after consultation with the Vanuatu National Cultural Council, classify as national heritage any site or object of: (a) historical significance; or (b) archaeological significance; or (c) ethnological significance; or (d) artistic significance. A register of classified sites and objects shall be kept by the Vanuatu Cultural Centre.

Occupier's Liability Act 1962.

This Act defines: the liability of an occupier of a leased area or premises including a leased or licensed area under the Marine Farming Act 1971 in respect of visitors or licensees of the leased premises; and the relationship with respect to liability between a tenant and landlord. The Act also defines some duties of a landlord with respect to maintenance of the leased premises.

Public Lands and Resources (Reclamation Amendment) Act 2008 (P.L.2008-2).

This Act amends the Public Lands and Resources Act by; giving definitions of “Adjoining lands”, “Land-fill”, "Lands reclaimed from marine areas below the ordinary high water mark" or "reclaimed lands", "Marine areas below the ordinary high water mark" and "Ordinary high water mark"; and inserts a new section (105) for purposes of confirming ownership of newly constituted lands by the owners of adjoining lands.
