Location

The FAO Legal Office provides in-house counsel in accordance with the Basic Texts of the Organization, gives legal advisory services to FAO members, assists in the formulation of treaties on food and agriculture, for which the Director-General acts as Depositary, publishes legal studies and maintains a database (FAOLEX) of national legislation and international agreements concerning food and agriculture (including fisheries, forestry and water).

Titles Registration and. Derelict Lands Act [Chapter 20:20].

Persons having acquired a just and lawful right of title in derelict lands, either by prescription or by contract or in any other manner, may apply to the High Court to order the registration of such title (sect. 3). Section 4 provides for the application for the registration of land by persons entitled to "expropriate" such land. Section 5 provides for the application to the high Court for relief by persons having a claim on derelict land.

Alienated Land (Information) Act [Chapter 20:02].

This Act concerns control on the use of alienated land. Whenever the President considers it necessary or expedient to do so, he or she may make Regulations for the purpose of ascertaining the nature and extent of the occupation or use of alienated land (sect. 2). The Regulations may, among other things, require owners or occupiers of alienated land to supply specified information and prescribe powers and duties of officers appointed under section 4. Such officers may be appointed by the Minister for the purpose the nature and extend of occupation and use of alienated land.

"Land amelioration" is defined in section 2 as "the drainage, irrigation or double-purpose regulation of water conditions, also the application of agromeliorative or land cultivation measures". Another key term used in this Law, "Amelioration System" (abbreviated "AS") is defined as "the complex of buildings and constructions for drainage, irrigation or double regulation of water conditions". This Law makes provisions in 25 sections for the construction, ownership, use and maintenance of Amelioration Systems and the creation of Amelioration Associations.

These Regulations amend the principal Regulations which provide for payment to eligible persons who, in respect of an area of eligible land, undertake not to use such land for a period of at least twenty years and to manage the land with the objective of establishing an area of salt-marsh in accordance with prescribed management requirements. They amend the rate of payment of aid to beneficiaries in respect of land which was permanent grassland at the start of the management period.

These Regulations implement in part Council Regulation (EC) No. 2078/92 on agricultural production methods compatible with requirements of environment protection and the maintenance of the countryside. they provide for payment to eligible persons who, in respect of an area of eligible land, undertake not to use such land for a period of at least twenty years and to manage the land with the objective of establishing an area of salt-marsh in accordance with management requirements as set out in the Schedule.
