The present Law lays down provisions relating to land survey and cadastre in Sachsen-Anhalt. In particular, article 1 establishes that the Survey and Cadastre Authority is responsible for the national survey of land and the running of the land survey register. The present Ordinance implements the Sachsen-Anhalt Land Survey Cadastre Law of 22 May 1992. Article 2 of the above-mentioned Ordinance establishes that the mandatory content of the cadastre (property data) consists of, inter alia, the geometrical data, descriptive data, ownership information and Land Registry data. The text, consisting of 12 articles, deals, inter alia, with the following aspects: content of land survey register, designation of boundaries, marking, protocol of land boundaries, expropriation proceedings.

This Decree amends the Land Transfer Act in section 159 by adding 8 new subsections in relation with the registration of an easement over a subdivisional lot by the Registrar and compensation or legal proceedings in relation with a decision of the Registrar to register such easement.

This Act provides for the registration of documents by the Office of the Registrar-General and provides for the keeping and inspection of such documents. The Registrar-General shall be the authority for, among other things: recording and registering mortgages and other conditional conveyances of property under the Mortgage Registration Act 1786; recording and registering voluntary conveyances of land under the Conveyancing Act 1983; deposit of memoranda respecting the acquisition or disposal of land by bodies corporate under the Corporate Bodies' Lands Act.

These Regulations, made under section 5 of the Registrar-General (Recording of Documents) Act 1955: provide rules relative to the form of documents submitted to the Registrar-General for recording or registration; appoint authorized officers for purposes of the Act; and require the metric system to be used for measurements in documents, including survey plans. Forms for the Memorandum of mortgage, Memorandum of acquisition of land from and/or by alien and a Memorandum relative to voluntary conveyances are set out in the Schedule.

The present Law lays down provisions relating to the keeping of the land register in Saarland. Land survey as well as running the land register are both public tasks which according to article 2 of the present Law are carried out by the Cadastre, Survey and Mapping Office and other public entities. The asset register of state-owned agricultural, forestry and other lands must be kept by the National Land Fund Managing Organization. This Decree determines the kind of information to be included in the register, such as data regarding the location of the property or information regarding rights and obligations on a property.

The present Law lays down provisions relating to land survey and the running of the land cadastre. Article 1 of the above-mentioned Law lists the functions of the official surveying and mapping, such as: 1) national land survey; 2) running of land cadastre; 3) conducting property surveys, including demarcation of parcel of lands; 4) producing evidence of borders; 5) providing geo-data information.

The Cadastral Diagram represents the detailed form of information contained in the database of the National Cadastre and it constitutes the background basic information on which the Diagram of geometric amendments is depicted. With this Diagram, changes on delimitation of land can be requested. The Decree prescribes the information which must be included in the Diagram and establishes that its issuance shall be free of charge for the public administration.
