El presente Decreto reglamenta la Ley Nº 333 de 1996, en lo relativo a la destinación provisional y asignación definitiva de los bienes rurales con caracterizada vocación rural en favor del Instituto Colombiano de la Reforma Agraria (INCORA), y dicta disposiciones relacionadas con su adjudicación.

The report of a project exploring human security and land rights in Cambodia. The project used a human security framework to address two questions: (1) What kind of insecurities do people in areas with land disputes have, and who is most insecure? (2) What provides people with security, and how does land policy relate to other sources of security over land? The study involved more than 400 participants in Kampong Chhnang, Ratanakiri, and Phnom Penh. The study shows that insecurity over land is about wider issues of poverty environment and livelihood insecurity.

Whereas 2011 had seen a sharp increase in the number of Economic Land Concessions (ELCs) granted by the Royal Government of Cambodia to private companies, in 2012 conflicts became more acute and protests multiplied. The government showed that it had understood the seriousness of the situation by taking initiatives aimed at resolving land disputes, addressing some of the issues related to ELCs and granting thousands of land titles to rural families.

The Office of the UN High Commissioner for Human Rights in Cambodia (OHCHR) has undertaken the present study to measure the human and socio-economic costs and impacts of eviction and resettlement in Cambodia, and explore solutions based on the Royal Government of Cambodia's domestic laws and policies and international human rights treaty commitments.

A decade ago in Mozambique, a stakeholder workshop where the need to improve access to industrial and commercial land as a means to encourage investment was a topic of discussion, a government official came up to. In order to create new jobs, generate more income, and modernize the economy, many countries see an urgent need to encourage industrial and commercial investment, both domestic and foreign. However, investment in many sectors cannot take place unless land, along with other basic factors of production, is available.

In this introduction, the authors do three things. They first introduce the puzzle and relate it to existing interpretations from market reformists and their critics, arguing that both sets of views are inadequate. The authors then offer an alternative interpretation: that entrenched inequities sustained by a rent-sharing political equilibrium are a primary source of inefficiencies and weak growth. Moreover, this equilibrium has been resilient to democratization in ways that can be explained by the nature of the underlying forces.

In May 2010, the Cambodian Government approved a circular on "resolution of temporary settlement on land which has been illegally occupied in the capital, municipal, and urban areas" (Circular 03). The aim of this report is to highlight some of the issues arising from Circular 03 as a policy document, and draw attention to the opportunities and risks arising from its implementation.

El presente material es un breve compendio de las leyes y normativas vigentes, que regulan el acceso a la tierra por parte de la población, con particular detalle en el caso de los campesinos y campesinas. En el caso de las comunidades indígenas, se hará una breve mención a la legislación correspondiente.

El caso de comunidades migrantes que se establecen en tierras baldías y luego, el Estado construye una represa que inunda sus tierras, y los desplaza, afectando su vida, y obligándolos a años de lucha demandando una justa indemnización y la dotación de nuevas tierras.

El citado Digesto refleja los debates y problemas jurídicos que han tenido que resolver los jueces ante el alto número de conflictos sociales relacionados con la propiedad de la tierra, el territorio y los recursos naturales de los pueblos indígenas.

La publicación aborda tres aspectos centrales de la problemática actual de la tierra en Paraguay: una aproximación a la demanda existente de tierras por parte de la población campesina e indígena, las políticas  públicas relacionadas al acceso a la tierra, y finalmente, aspectos fundamentales de la legislación vigente en esta materia.
