A law & economics approach to the study of integrated management regimes of estuaries

In this paper it is proposed to analyse legal regimes for integrated management of estuaries with the help of institutional legal theory and the Schlager & Ostrom framework for types of ownership. Estuaries are highly valued and valuable and therefore need protection. The problem is that they qualify as multiple-use and multiple-user common pool resources. To be able to analyze the legal regimes governing the estuaries, you must be able to take the position of governmental actors and NGO's into account.

Although ancestral rights to land are a cornerstone of the livelihoods of indigenous peoples, few countries have been ready to undertake their recognition. Lack of political will together with obstacles such as lack of legal recognition of indigenous rights in national legal frameworks and tenure regimes, different forms of discrimination and inappropriate policies towards indigenous peoples are at the root of some of the limitations that are found with regard to the recognition of indigenous peoples’ land rights.

Puesto que no se trata de un estudio comparativo entre éste y otros tipos de enfoques, no se han tomado en consideración casos de planteamientos más “tradicionales”.

Este manual de campo contiene las definiciones y procedimientos utilizados para planificar y realizar un inventario y evaluación forestal nacional siguiendo el método desarrollado por el programa de Evaluación de Recursos Forestales (ERF) de la FAO. La metodología, basada en un muestreo de campo a nivel nacional, ya ha sido ensayada y aplicada en varios países desde el año 2000 (Costa Rica, Guatemala, Filipinas, Camerún y Líbano).

The Global Forest Resources Assessment Update 2005 was specially mandated by the Committee on Forestry (COFO) during its meeting in 2003, where member countries endorsed recommendations from an Expert Consultation held in the Kotka, Finland in 2002 (Kotka IV). For this purpose, all countries have been requested to provide national reports to FAO during 2004. As in previous global assessments, FRA 2005 relies on contributions by countries and a network of National Correspondents to FRA has been established.

The Expert Consultation on Criteria and Indicators for Sustainable Forest Management (ECCI-2004) was organized by the Forest Management Bureau of the Philippines, the Food and Agriculture Organization of the United Nations and the International Tropical Timber Organization and convened in Cebu City, Philippines, from 2 to 4 March 2004. The Forest Management Bureau of the Philippines hosted the meeting.

This field manual contains definitions and procedures used to plan and perform a national forest inventory and assessment following the approach developed by the Forest Resources Assessment programme (FRA) of the FAO. The methodology, based on nation-wide field sampling, has already been tested and implemented in several countries since year 2000 (Costa Rica, Guatemala, Philippines, Cameroon and Lebanon).
