This Ordinance, made under sections 29(3) and (4), 31(2) and (3), 33(4) to (6), 35(2), 43(5), 81 and 89 of the Land Planning and Development (Guernsey) Law, 2005, concerns special development control for protected monuments and buildings and protected trees. The Ordinance, among other things, defines the content of Tree Protection Orders and the effect of such Orders and sets out procedures after the making of an Order and in respect of confirmation of an Order. A register of Tree Protection Orders shall be kept by the States of Guernsey Environment Department.

This Order, made under section 31 of the Land Act, provides that on the land described in the First Schedule no control person shall, without the prior consent of the Minister or his or her authorized representative: (a) make any new garden; (b) plant any tree or shrub; (c) erect any building of any description whatsoever; (d) hunt or carry any firearm; (e) set fire to any vegetation.

This Order of the Minister, made pursuant to section 41 of the Land Act, delegates to and authorizes, subject to his or her special and general directions, the Project Manager, the Chief Settlement Officer, the Settlement Officer or the Assistant Settlement Officer to sign and issue Settlers Licences in connection with any agricultural settlement or re-settlement scheme in any Region of Malawi.

This General Notice, made under section 6 of the Deeds Registration Act, exempts all Licences for the occupation of land issued by the Minister under the powers conferred upon him or her by section 5 of the Land Act in connection with Agricultural Settlement or Re-Settlement in any part of Malawi, from the requirement of registration as provided for in the Deeds Registration Act.

The present Regulation is made under the Assessment Act. Section 1 establishes that an application under section 23(1) of the afore-mentioned Act by an owner of land to have all or part of that land classified as a farm must be in the form entitled "General Application for Farm Classification" set out in Schedule 1. The present Ordinance implements the Federal Agricultural Act of 2 September 1979. Article 1 establishes that the Office of Landscape and Nature is responsible for the enforcement of the afore-mentioned Federal Agricultural Act, unless otherwise determined.

These Regulations implement the Land Administration Act 1997.The Regulations provide for the delegation under section 9(1) of powers conferred or duties imposed by the Act to convey or transfer the fee simple in Crown land.

The present Ordinance implements the Federal Agricultural Lease Act of 4 October 1985. Farmers living in the area enjoy priority rights in case of lease of alpine pastures. Otherwise the competent authority shall advertise such a lease in the legal gazette. The present Regulation implements the Federal Act on land law and land rights of 21 December 2004. In particular, it lays down provisions relating to land rights in the Canton of Obwalden. Furthermore, it establishes a Land Right Commission (Bodenrechtskommission).The said Commission shall, inter alias, survey subdivisions of agricultural land and registrations in the cadastre.
