Illegal Land Use in the Netherlands: An Explorative Empirical Study on the Use of Municipal Land Without Any Right

Throughout the Netherlands, land owners (or their lessees) use adjacent public or private land without any right. There is, however, no scientific empirical data on how often and where land is illegally used. On the basis of empirical case studies, this research has the following aims: make an estimate of how often illegal land use occurs in the Netherlands; which kind of land is illegally used; in what kind of spatial context it is illegally used; and for what purpose it is illegally used.

Women and Land in Pakistan

Women have largely been excluded from the ownership and control of land in Pakistan, which is the single most important source of income and status in the agricultural economy. This systematic exclusion stems from multiple factors at both the policy and societal level, which include multiple and contradictory sources of law that fail to resolve the issue of women’s right to property as well as cultural bias and discriminatory practices that arise from the prevalent male-dominant mindset in rural areas.

A land audit responding to the facts that policy formulation around the very sensitive and complex issue of land has been based on perception rather than fact for too long and that no reliable figures on land ownership in South Africa exist. Acknowledges that there are still some gaps in the data, but presents statistics that  shed light on ownership patterns of agricultural land in South Africa. Required a multi-pronged approach. The amount of agricultural land has decreased from approximately 79.3% in 1994 to 76.3% in 2016.

Drones are taking to the skies above Africa to map land ownership

A Kenyan air pilot involved in a project testing the use of drones for land mapping and registration in Kenya, Rwanda and Ethiopia. If successful, hopes it will be rolled out elsewhere on the continent. Still awaiting permission to fly the drones. Kenya has developed guidelines on drones. Hoped to increase the number of land parcels that are mapped and clarify figures for different types of land ownership – private, public or community.

The scope of this Law shall be to prevent speculation in agricultural land and preserve traditional forms of farming; to create conditions for the formation of rational land holdings and land consolidation; and to promote the rational use of agricultural land. It shall not be applicable to agricultural land of subsistence farming, land used for horticulture and gardening, and inherited land and land owned by the way of restoration of legal rights of ownership.

Article 38 (1) shall be amended to add the following wording: “Article 38 (1). The use of agricultural land for rural tourism (agro-tourism). Owners of agricultural land can place on these lands structures for the reception of tourists of the category of agrotouristic boarding house without changing the designation of the respective land. The aforesaid right can be realized if the owner of agricultural land is engaged in agricultural activities for at least five years". Article 99 shall be amended to add the following wording: “Article 99.

En virtud de la presente Ley se prorrogan hasta el 23 de noviembre de 2021 los plazos establecidos en los artículos 1°, 2° y 3° de la Ley Nº 26.160, por la que se declaró la emergencia en materia de posesión y propiedad de las tierras que tradicionalmente ocupan las comunidades indígenas originarias del país. Dichos plazos se refieren a la suspensión de la ejecución de sentencias, actos procesales o administrativos, cuyo objeto sea el desalojo o desocupación de las tierras mencionadas.

Who owns the land? Half an answer from AgrisSA land audit

Farmers’ interest group AgriSA last week released its own land audit. This filled in a major blank in the land reform and policy field: How many black emerging farmers have bought farms outside government’s land reform programme? We now have a part answer: they bought 4.3 million hectares.  Other findings from this study are contested and methodological flaws are highlighted.

This paper deals with strategies to overcome barriers to agricultural extension and advisory services for women in agriculture. In targeting extension services towards women in the agricultural value chain, specific challenges cited in the study surveys are: small farm sizes due to lack of access to land; limited access to credit, input supply, and assets; and inadequate access to tractor services. Men have main access to silos and warehouses for grain storage.
