Quieting Titles Act, 1959 (Cap. 393).

This Act concerns legal proceedings and proof regarding the ascertainment or evidence of title in land or interest in any estate.The Act sets out the procedures for obtaining a certificate of title and the effects of a certificate of title. The Act also allows a person to request a court to investigate matters that may affect a title in land. A certificate of title obtained by fraud shall be null and void. The Rules Committee of the Supreme Court may make rules for specified purposes.

Validation of Gratuitous Conveyances Act (Cap. 157).

This Act creates a general validation of acts of conveyances, for which no or no adequate compensation has been given to the conveyor, of real and personal property including leases, mortgages and any other instrument purporting to effect the transfer of any estate or interest in real or personal property from a company to any person. The Act consequentially extinguishes claims adverse to such conveyances. The provisions of this Act shall not affect bona fide purchase or invalidation of fraudulent conveyances by court.

This Act makes provision for selected matters in relation with property and in particular immovable property.The Act provides rules relative to licensed activities in respect of leases and other effects of legal deeds or proceedings on lease, effects of release from a rentcharge or judgements of parts of hereditaments charged therewith on unreleased parts, executions of deeds, illegal practices with deeds, duties of trustees and executors in respect of existing leases and other matters regarding land under inheritance or intestate.

Transfer of Property Tax Law (No. 11 of 1963).

This Act imposes a property tax when there is a transfer of ownership of property to persons who are not citizens of Sri Lanka. They shall be charged from the transferee of such property an amount equivalent to the value of that property (sect. 2). The tax shall be paid to the Registrar of Lands in that district and paid into a Consolidated Fund. Section 3 concerns the effects of non-payment whereas there are provisions concerning the procedure for recovering due tax (sect. 8). There are further provisions regarding offences and a list of definitions relevant to the Act.

Land Resumption Ordinance.

This Ordinance relates to lands alienated by the Crown which are abandoned by their owners. The Government Agent publishes notices calling upon owners of abandoned land to prefer their claims (sect. 2). Every notice must be published in the Gazette (sect. 2). Where no claim is made in pursuance of such a notice, the Government Agent shall report to the Minister in order to make an order of resumption by the State (sect. 3). There are further provisions concerning the procedures for claims, power of Government Agents and penalties relevant to the Act.

A compter de la promulgation de la présente loi, la propriété des terres à vocation agricole ne peut appartenir qu'à des personnes physiques de nationalité tunisienne ou à des sociétés coopératives constituées dans les conditions prévues par la loi nº 63-19. Les propriétés agricoles qui ne se trouvent pas dans l'un de ces cas sont transférées au domaine privé de l'Etat.

La presente Ley dispone que las poblaciones estables asentadas en tierras de propiedades privadas, sean dichas poblaciones rurales o urbanas, siempre que tengan 20 años o más desde su fundación y que no se hayan originado en razón de las actividades de los propietarios ni respondiendo a planes de éstos, se conocerán como colonizadores o urbanizaciones de hecho, según los casos, y que quedarán sujetas a las disposiciones de esta Ley.

This Regulation consists of 7 Sections divided into 23 articles. Section I establishes the Cadastre and Documentation Department of the Ministry of Justice and defines its duties. Section II deals with land ownership rights. Section III pertains to booking and registration. Section IV and V define the registration measures. Section VI defines steps and measures for the authentication of signatures, as well as fixes registration fees. Section VII contains temporary provisions.

The provisions of the Regulation establish the modalities of application for obtaining special permit for removal and transfer of the fertile soil layer of the plots of land that are compulsory for land users whose activity is related to the disturbance of the upper (fertile) soil layer.
