Land Assembly Project Area Act (SA 2009, c L-2.5).

The present Act was created to provide a clear process for property owners when government needs to plan for long-term, large-scale transportation projects (like ring roads or water reservoirs). The legislation ensures landowners are consulted and fairly compensated, and gives property owners choices and options respecting their land. Property owners whose land is designated for a project will have a number of options: 1) They can sell their land to the government having thus the option to have determined the price by a third party, the Land Compensation Board, or by the courts; 2) They can require the government to expropriate their property under the Expropriation Act; 3) They can sell their land to the government and lease it back until the project is ready to begin; 4) They can choose not to sell their land until the project is ready to begin; 5) They can also sell their property to a third party, or leave it in their will for family members.
