    This Decree-Law establishes that matters concerning usufruct, lease or joint lease of rural lands, or portions of them, are under the Law Courts' jurisdiction (art. 1). This Decree-Law deals with cases in which a tenant, or usufructuary, has been evicted. It establishes defences which can be presented (with or without legal representation) to the local Law Court, according to the Civil Code (art. 2). The evicted tenant may request the temporary return of the land in compliance with arts. 393-395 of the Civil Code (art. 3).

    Cette loi porte institution d'une taxe de jouissance pour l'occupation et la jouissance des terres du domaine foncier national appartenant à l'Etat. Cette taxe est due par la suite de l'attribution de gré à gré, de l'adjudication, de la mutation et de l'apport en société d'une terre du domaine foncier national appartenant à l'Etat non mise en valeur, même si le titulaire du droit de jouissance n'occupe pas effectivement le terrain.

    This Act provides in 30 articles divided into 8 Parts for the establishment of a Land Surveyors Board (sect. 3) and for the control and procedures of the surveying of land by surveyors licensed under this Act. The Board is responsible for the licensing of surveyors and to control their functioning (sect. 5). Part III specifies the criteria which persons shall meet in order to be eligible to become a licensed surveyor (sects. 7 and 8). It also provides for the establishment of a register of licensed surveyors (sect. 9).

    The Act provides in Part II for the establishment of a Planning Board (sect. 3) and Planning Authority for each planning district (sect. 5). There shall be 4 types of draft plans for spatial development of land. These are: National Plans; Divisional Plans; Development Plans and Local Plans (sect. 8). The Board shall prepare a National Plan for the Gambia. The Board shall also draft Division Plans for each Division of the Gambia (sect. 11). The Board shall, within the framework of the plans aforementioned, prepare development plans for the area covered by that plan.
